1. Approve the enclosed Rules of charge, use, return of the start educational capital according to appendix to this order.

2. To provide to committee of the higher and postgraduate education of the Ministry of science and the higher education of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its placement on Internet resource of the Ministry of science and the higher education of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-minister of science and the higher education of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of charge, use, return of the start educational capital

Chapter 1. General provisions

1. These rules of charge, use, return of the start educational capital (further – Rules) are developed according to the subitem 6) of article 4 of the Law of the Republic of Kazakhstan "About the State educational accumulative system" (further – the Law), Item 8 of article 3 of the Law of the Republic of Kazakhstan "About housing construction savings in the Republic of Kazakhstan" and determine procedure for charge, use, return of the start educational capital.

2. For the purposes of these rules the following concepts are used:

1) the start educational capital – the lump sum payment from the budget enlisted on educational accumulation deposit of the investor or on estimated amount under the agreement of educational accumulative insurance;

2) the agreement of educational accumulative insurance (further – the insurance contract) – the agreement of accumulative life insurance according to which one party (insurer) shall pay insurance premium and other party (the insurance participating organization) shall perform as a result of emergence of insured event the insurance payment calculated including, proceeding from the added investment revenue;

3) educational accumulation deposit (further – contribution) – the money on the account of the investor in participating bank including fees of the investor or vnositel, including due to payments of target accumulatings from the single accumulation pension fund for the purpose of payment of education according to the laws of the Republic of Kazakhstan, the start educational capital, award of the state and the capitalized remunerations of participating bank;

4) the agreement on educational accumulation deposit (further – the agreement of contribution) – the bank deposit agreement on accumulating of means for payment of educational services signed by the investor with participating bank;

5) the organization of participating education – the legal entity created and who is acting in the territory of the Republic of Kazakhstan, realizing educational programs of technical and professional, postsecondary, higher and postgraduate education and signed the agreement on cooperation in the field of the State educational accumulative system with the operator in the field of the State educational accumulative system;

6) authorized body in the field of science and the higher education – the central executive body of the Republic of Kazakhstan performing management and cross-industry coordination in the field of the higher and postgraduate education;

7) participating bank – bank of the second level of the Republic of Kazakhstan, the National operator of mail who is meeting the established Law the requirements and signed the agreement on cooperation in the field of the State educational accumulative system with the operator in the field of the State educational accumulative system;

8) award of the state – money annually at the scheduled time paid for the account of budget funds on actually cumulative remaining balance of educational accumulation deposit and on estimated amount according to the insurance contract;

9) the operator in the field of the State educational accumulative system (further – the operator) – the organization determined by the joint decision of authorized body in the field of science and the higher education, and authorized body in the field of education, performing coordination of activities of participants of the State educational accumulative system and providing its functioning in limits, stipulated by the legislation the Republic of Kazakhstan;

10) the beneficiary – person who according to the insurance contract is receiver of insurance payment;

11) estimated amount according to the insurance contract – the amount accepted for calculation of award of the state, determined proceeding from the created insurance reserve by the insurance contract taking into account insurance premiums (insurance premiums), the start educational capital, investment revenue, the added awards of the state of the last periods;

12) the insurer – the person who is the parent or other close relative, the legal representative of the beneficiary and signed the insurance contract with the insurance participating organization (according to the Law the insurer is insured);
