About approval of the Regulations on implementation of energy audit by large enterprises

Based on Item g) parts (1) article 9 of the Law No. 139/2018 on energy efficiency (The official monitor of the Republic of Moldova, 2018, Art. No. 309-320, 476), with subsequent changes, DECIDES: the Government

1. Approve Regulations on implementation of energy audit by large enterprises it (is applied).

2. To public organization "National Center for Steady Energy" within one month from the effective date of this resolution to notify the first large enterprises on need of implementation of energy audit according to the requirements and the principles provided by Regulations on implementation of energy audit by large enterprises.

3. To the large enterprises determined by National bureau of statistics and notified by public organization "National Center for Steady Energy" to constitute and provide to public organization "National Center for Steady Energy" the first report of energy audit within one year from the date of publication in the Official monitor of the Republic of Moldova of Regulations on implementation of energy audit by large enterprises and further – at least once in four years from the date of creation of the last report of energy audit.

4. To the large enterprises determined by National bureau of statistics in year from the effective date of Regulations on implementation of energy audit by large enterprises and obliged to perform energy audit, to constitute and provide to the address of public organization "National Center for Steady Energy" the first report of energy audit within one year from the date of receipt of the notification from public organization "National Center for Steady Energy" and further to book audits at least once in four years from the date of implementation of the last energy audit, with representation to public organization "National Center for Steady Energy" of the reports of energy audit developed for this purpose.

5. To large enterprises which carried out energy audit before entry into force of the Regulations on implementation of energy audit by large enterprises to provide the copy of the report on the booked audit and further at least once in four years from the date of creation of the last report of energy audit to submit the new report of energy audit conforming to requirements of the specified Provision.

6. To represent to public organization "National Center for Steady Energy" after approval of the Regulations on implementation of energy audit by large enterprises in the activities report, performed in previous year, information on its implementation.

7. To assign monitoring of accomplishment of this resolution to the Department of Energy.

Regulations on implementation of energy audit by large enterprises

Chapter I General provisions

1. The regulations on implementation of energy audit by large enterprises (further – the Provision) establish:

1.1. procedure for determination of large enterprises and criteria of creation of the list of large enterprises which shall perform energy audit according to requirements of this provision;

1.2. obligations of large enterprises and requirement to implementation of energy audits;

1.3. procedure for submission by large enterprises of the reporting under energy audits;

1.4. procedure for monitoring of implementation of energy audits by large enterprises;

1.5. requirements to large enterprises in case of implementation of system of energy or ecological management.

2. This Provision is applied by the central industry body of public management in the field of power and auxiliary public organization – Public organization "National Center for Steady Energy" (further – PU NTsUE) in the course of implementation of energy audit by large enterprises.

3. For the purposes of this provision concepts which are given definition in the Law No. 139/2018 on energy efficiency are applied.

4. PU NTsUE performs the following functions:

4.1. applies the legal base on implementation of energy audit by large enterprises;

4.2. gives consulting and information help to service providers of energy audit, power accountants and the companies performing business activity concerning features of carrying out energy audit by large enterprises;

4.3. determines, constitutes and updates the list of large enterprises which shall perform energy audit, and notifies them on it;

4.4. cooperates for the purpose of determination and creation of the list of large enterprises, in particular, by mutual and permanent provision of information with National bureau of statistics, the Department of Energy, the Ministry of Economic Development and digitalizations, and also with other bodies of the central and local public authority;

4.5. develops, claims and publishes sample of the report on annual primary energy consumption of large enterprises which shall perform energy audit on the official website;

4.6. updates, if necessary, programs of professional training of power accountants.

Chapter II Creation and updating of the list of large enterprises

5. As large enterprises in value of this provision the companies which are not falling under operation of the Law No. 179/2016 on small and medium scale enterprises, and answering in total to the following conditions are determined:

5.1. their annual average number of workers (the average number of personnel for the accounting period) exceeds 249 people;

5.2. their annual turnover (sales returns) exceeds 100 million lei or they own total assets (non-current and current assets) in the amount of more than 100 million lei, according to the last approved financial statement;

5.3. their annual primary energy consumption exceeds 1 000 tne.

6. The list of large enterprises which shall perform energy audit is constituted according to the following procedures:

6.1. PU NTsUE annually requests from National bureau of statistics of submission of the list of the companies which perform business activity in the forms of business specified in article 13 of the Law No. 845/1992 on entrepreneurship and the companies and do not fall under operation of the Law No. 179/2016 on small and medium scale enterprises, and their annual consumption of primary energy exceeds 1 000 tne;

6.2. The national bureau of statistics annually provides the most up-to-date information available at the level of statistics requested according to subitem 6.1 provisions in the address PU NTsUE.
