Concept of the Eurasian social charter

Eurasian social charter of Eurasian economic community, being regulatory legal act of Community, it is aimed at providing to the people of state members of EurAsEC civil and the political right and freedoms provided by the Agreement on deepening of integration in economic and humanitarian areas of March 29, 1996 and other documents existing within EurAsEC.

Realization of provisions of the Charter assumes implementation of the social rights without any discrimination.

International Covenant on Economic, Social and Cultural Rights of 1966,

Charter of the European community about the basic social rights of workers of 1989,

Code of social security of 1990,

Charter of the social rights and guarantees of citizens of the independent states of 1994,

the tripartite Declaration of the principles concerning multinational corporations and social policy, the accepted ILO in 1977

conventions and recommendations of the ILO.

State members of EurAsEC realize the approved social policy based on the principles:

- economic human freedom, its right to the free choice of any kind of activities in the field of wage labor and entrepreneurship;

- trust to the regulating market role;

- cost efficiency of social market economy;

- social justice and social solidarity of society;

- availability and free of charge education on competitive basis;

- equal rights of citizens on receipt of general and professional education;

- participations of all citizens in management of the public and public affairs, and also participations of workers in production management and developments of system of social partnership.

The specified principles are provided by development of stock ownership of workers, tax income redistribution from the rich to the poor, bigger load of the most able-bodied members of society to help disabled.

The Eurasian social charter assumes implementation of the approved social and economic policy within Community by means of all due means of both national, and interstate nature, creation of the conditions providing effective implementation of the following rights:

* each person shall have opportunity to earn to himself living by freely chosen work;

* all workers have the right to fair working conditions;

* all workers have the right to the working conditions meeting safety requirements and hygiene;

* all workers have the right to the fair remuneration sufficient for maintenance of normal level of living of their and their families;

* all workers and employers have the right to free consolidation in the national or international organizations for protection of the economic and social interests;

* all workers and employers have the right to sign collective agreements;

* children and teenagers have the right to special protection against danger of physical and moral damage to which they are exposed;

* the working women during pregnancy and other working women in necessary cases have the right to special protection of their work;

* each person has the right to the corresponding conditions for professional orientation, the help in choice of profession which would be equitable to its personal capabilities and interests;

* each person has the right to the corresponding conditions for professional training;

* each person has the right to use all means promoting achievement by it of the best the state of health, possible for it;

* all workers and their dependents have right to social insurance;

* each person who does not have sufficient means of livelihood has the right to public and medical care;

* each person has the right to services from social services;

* disabled workers have the right to professional training, professional and social readaptation, irrespective of the reasons and nature of disability;

* the family which is the main cell of society has the right to the corresponding social, legal and economic protection for the purpose of ensuring its all-round development;

* mothers and children, irrespective of their marital status and family relations, have the right to the corresponding social and economic protection;

* citizens of the states of Community have the right to be engaged in the territory of any state of Community in any revenue-producing activities on an equal basis with citizens of the state of stay, except for the restrictions caused by the good economic or social reasons;

* the migrant workers who are citizens of the state of Community and also their families have right of defense and the help in the territory of any state of Community.

The approved social and economic policy of gosudarstvchlen of EurAsEC guarantees:

- observance of human rights and freedoms;

- carrying out active economic, social and gender policy;

- creation of system of the unified social and economic measuring instruments (indicators): lower, threshold, values for which transition leads to social tension and as a result, to threat of economic and public safety; upper, minimum with step-by-step achievement of high social standards of level and quality of life of citizens;

- targeted support of the most vulnerable layers and national groups, reducing and liquidation of poverty;

- creating favorable conditions for real participation of citizens in development and social examination of decisions at all levels of the power and management;

- observance of the rights and guarantees recognizing and developing system of social partnership in quality of the main mechanism of achievement of public consent and balance of interests of the worker and the employer in case of the regulating role of the state;

- protection and strengthening of family, spiritual, cultural, moral development of citizens and first of all youth;

- careful attitude to heritage of ancestors and succession of generations, preserving identity of national and historical traditions.

The social policy in state members of EurAsEC realized according to Eurasian social charter shall be performed in such main spheres of the social relations as:

- labor market, employment, payment and labor protection;

- income adjustment and consumption of mass market products;

- provision of pensions;

- provision of the address public assistance;

- social insurance;

- social servicing, provision of housing, utility and household services;

- professional training, retraining and advanced training;

- demand of personnel capacity of society;

- science, health care, culture;

- physical culture, sport and tourism;

- demography, family, motherhood, paternity, childhood and youth;

- ecological safety;

- protection against natural and technogenic accidents and catastrophic crashes;

- protection of the social rights of all categories of citizens.

The priority directions of social policy are determined by state members of EurAsEC independently taking into account the main directions of the approved social policy provided by the Eurasian social charter.

Forming of the approved social policy of gosudarstvchlen of EurAsEC is performed by determination of strategic objectives, the approved social indicators, levels - in process of readiness of the states of Community to adjust national priorities in process of integration interaction.
