About procedure of payments of the amount of participation of the foreign capital in the aggregate authorized capital of the credit institutions having the license for banking operations and branches of foreign banks

1. The amount of participation of the foreign capital in the aggregate authorized capital of the credit institutions having the license for banking operations (further - credit institutions), and branches of foreign banks (further - the amount of participation of the foreign capital in bank system of the Russian Federation) is calculated the Bank of Russia according to part one of article 18 of the Federal law "About Banks and Banking Activity" (in edition of the Federal Law of February 3, 1996 No. 17-FZ) (further - the Federal Law "About Banks and Banking Activity") on the basis of the data which are available in the Bank of Russia about:

to the cumulative size of foreign investments of nonresidents in the authorized capital of credit institutions;

cumulative size of the authorized capital of credit institutions;

to the cumulative size of the minimum security deposits of all branches of foreign banks.

2. The amount of participation of the foreign capital in bank system of the Russian Federation is calculated by formula:

- the cumulative size of foreign investments of nonresidents in the authorized capital of credit institutions which is determined on the basis of the data on paid shares (shares) of credit institutions and their shareholders (participants) which are available in the Bank of Russia, including data on nominal value of the stocks (shares) of credit institutions owned by nonresidents, except for the foreign investments specified in part two of article 18 of the Federal law "About Banks and Banking Activity";

- the cumulative size of the authorized capital of credit institutions when which calculating shares of credit institution are considered if for settlement date data on the size of the authorized capital of credit institution following the results of share placing are entered in the Unified State Register of Legal Entities state registration of the report on release results (additional release) of shares of credit institution is performed or the Bank of Russia receives the notification on release results (additional release) of shares of credit institution according to the Provision of the Bank of Russia of December 19, 2019 No. 706-P "About standards of issue of securities" <1>, state registration of the changes in the decision on share issue connected with change of share par value, and also share of credit institution in case is performed if for settlement date data on the size of the authorized capital of credit institution after payment by share are entered in the Unified State Register of Legal Entities;
