About education of persons with limited opportunities of health (vocational education)

This Law governs the relations arising in education of persons with limited opportunities of health (further - vocational education), and determines organization-legal and economic bases of vocational education.

Chapter I. General provisions

Article 1. Basic concepts

1.0. The basic concepts used in this Law express the following:

1.0.1. person with limited opportunities of health - person having physical, intellectual and (or) mental defects which interfere with education without creation of special conditions;

1.0.2. vocational education - preschool, general and professional education of persons with limited opportunities of health with creation of special conditions;

1.0.3. special conditions - the conditions created for obtaining by persons with limited opportunities of health of pedagogical, psychological, medical, social and other services;

1.0.4. physical defect - lack of physical development and (or) functioning of body (bodies) of the person, the temporary or permanent shortcoming which arose owing to chronic somatic or infectious disease;

1.0.5. mental variation - delay of mental development, including violation of the speech, the emotional and strong-willed sphere and autism;

1.0.6. difficult shortcoming - set of physical, intellectual and (or) mental defects;

1.0.7. intellectual shortcoming - shortcomings of memory and imagination as result of injury of the central nervous system;

1.0.8. heavy shortcoming - the high degree of physical, intellectual and (or) mental variation making impossible education according to state educational (special educational) standards;

1.0.9. special educational institution - educational institution, the performing educational process on the basis of special state standards of education for training of persons with limited opportunities of health;

1.0.10. special educational division - the structural division of educational institution of general purpose created for training of persons with limited opportunities of health;

1.0.11. educational institution of general purpose - the educational institution of professional education created for training of healthy faces;

1.0.12. inclusive education - involvement of children with limited opportunities of health to training in one class with healthy pupils by creation in educational institution of special conditions and by means of special training;

1.0.13. educational institution of the integrated training - educational institution in which special conditions for joint education by persons with limited opportunities of health and healthy faces are created;

1.0.14. training at home - development of general education programs by person who for health reasons does not have opportunities to study in educational institution, at home by means of pedagogical employees of the relevant educational institutions;

1.0.15. complete state providing - the state providing persons with limited opportunities of health educational means, food, clothes, footwear, the necessary equipment and individual technical means;

1.016. the assistant to the teacher - the qualified specialist giving help to the teacher in the organization of pedagogical process in educational institutions in which inclusive education is implemented;

1.0.17. stationary training - the organization of the general education in medical institutions according to the appropriate educational programs according to the procedure, established by body (organization) determined by relevant organ of the executive authority for persons which are on long-term treatment.

Article 2. Legislation of the Azerbaijan Republic on vocational education

The legislation of the Azerbaijan Republic on vocational education consists of the Constitution of the Azerbaijan Republic, this Law, other corresponding legal acts and international treaties which participant is the Azerbaijan Republic.

Article 3. Purpose of vocational education

The purpose of vocational education consists in ensuring adaptation of persons with limited opportunities of health in society, including developments of skills of self-service, preparation for labor activity and family life, by instilling of necessary knowledge, skills.

Article 4. Obligations of the state in the field of vocational education

4.0. Obligations of the state in the field of vocational education are:

4.0.1. provision of a guarantee on education at the expense of the state taking into account capabilities and opportunities of persons with limited opportunities of health;

4.0.2. preparation and implementation of target state programs in the field of vocational education;

4.0.3. determination of state standards of vocational education;

4.0.4. creation of conditions for obtaining by persons with limited opportunities of health of preparation on the specialties corresponding to their capabilities and opportunities;

4.0.5. provision of a guarantee on obtaining by persons with limited opportunities of health of professional education;

4.0.6. issue to persons with limited opportunities of health of the benefits established by the legislation;

4.0.7. provision of a guarantee on preparation, additional education of personnel in the field of vocational education;

4.0.8. application to organizations with vocational education of the privileges established by the legislation on payment of taxes and duties;

4.0.9. financing of vocational education at the expense of public funds;

4.0.10. strengthening of material and technical resources of organizations with vocational education.

Chapter II. The rights and obligations of persons with limited opportunities of health, their parents or other legal representatives in the field of vocational education

Article 5. The rights of persons with limited opportunities of health in the field of vocational education

5.0. In the field of vocational education of person with limited opportunities of health have the right on:

5.0.1. free inspection psikhologo - the medico-pedagogical commission and in body (organization) established by relevant organ of the executive authority;

5.0.2. free medico-psychology and pedagogical correction of physical, intellectual and (or) mental shortcomings according to the conclusion psikhologo - the medico-pedagogical commission;

5.0.2-1. Receive free psychological assistance according to the Law of the Azerbaijan Republic "About psychological assistance";

5.0.3. receipt of the preschool and general education based on the educational program and the individual curriculum of vocational education based on the decision psikhologo - the medico-pedagogical commission;

5.0.4. passing of preparation on mass specialties taking into account their capabilities, opportunities and interests;

5.0.5. receipt of free vocational education according to the procedure, established by relevant organs of the executive authority.

5.0.6. providing with the corresponding work on completion of education and professional training.
