About creation of the state register of invalid documents

(as amended on 13-06-2019)

For the purpose of ensuring execution of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About the State register of the population of the Azerbaijan Republic" of August 2, 2006 I decide No. 438:

1. Create the State register of invalid documents.

2. Determine that the State register of invalid documents is kept by Service of the State register of the population of the Azerbaijan Republic under the Ministry of Justice of the Azerbaijan Republic.

3. Approve "Provision on procedure for maintaining the state register of invalid documents" it (is applied).

4. Charge to the Cabinet of Ministers of the Azerbaijan Republic within two months:

4.1. resolve issue of allocation of financial resources for development of the specification on creation of the state register of invalid documents, including preparation of the software and ensuring information exchange;

4.2. resolve other issues following from this Decree.

5. Charge to the Ministry of Internal Affairs, to the Ministry of Defence, the Ministry of Foreign Affairs, the State Border Service of the Azerbaijan Republic, to the Ministry of transport, communication and high technologies of the Azerbaijan Republic to provide bringing the data which are subject to inclusion in the State register of invalid documents to Service of the State register of the population of the Azerbaijan Republic under the Ministry of Justice of the Azerbaijan Republic.

6. This Decree becomes effective from the date of publication.

Regulations on procedure for maintaining the state register of invalid documents

I. General provisions

1. This Provision is prepared based on the Presidential decree of the Azerbaijan Republic of August 2, 2006 No. 438 "About application of the Law of the Azerbaijan Republic "About the State register of the population of the Azerbaijan Republic" and establishes rules of creation, maintaining, use of the State register of invalid documents (further - the State register) and protection of its data.

2. The state register is the state information reserve reflecting in itself information on the invalid documents belonging to citizens of the Azerbaijan Republic, and also foreigners and stateless persons and forms of these documents (further - documents).

3. Activities of the State register are provided with subsystem "The state register of invalid documents" as a part of the State Register of the Population of the Azerbaijan Republic.

4. The purpose of forming of the State register is prevention by means of maintaining in electronic procedure for single document registration and the reasons of loss of force by them (further - the reasons of loss of force) illegal use of these documents.

5. The state Register is kept by Service of the State register of the population of the Azerbaijan Republic under the Ministry of Justice of the Azerbaijan Republic.

6. The service of the State register of the population of the Azerbaijan Republic under the Ministry of Justice of the Azerbaijan Republic provides forming, storage of databank of the State register of invalid documents, management to them, its integrity and protection.

6-1. The state register of invalid documents is integrated by means of the Interdepartmental automated "Entrance Exit and Registration" information retrieval system.

II. Creation of the state register

7. The state register is kept in state language of the Azerbaijan Republic.

8. The state register is kept on the following document types:

8.1. identity certificate of the citizen of the Azerbaijan Republic;

8.1-1. the individual ID card of the citizen of the Azerbaijan Republic who did not reach 15-year age;

8.2. all-civil, service and diplomatic passports;

8.3. identity certificates of the persons without citizenship who are constantly living in the Azerbaijan Republic before achievement of 16 years by them for use within the Azerbaijan Republic;

8.4. identity certificates of the persons without citizenship who are constantly living in the Azerbaijan Republic after achievement of 16 years by them for use within the Azerbaijan Republic;

8.5. identity certificates of the persons without citizenship who are constantly living in the Azerbaijan Republic for departure out of limits of the Azerbaijan Republic;

8.6. No. 977 is excluded according to the Presidential decree of the Azerbaijan Republic of 13.09.2013

8.7. the allowing certificate for temporary residence in the territory of the Azerbaijan Republic;

8.8. the allowing certificate for permanent residence in the territory of the Azerbaijan Republic;

8.8-1. the certificate of the refugee and the road document of the foreigner or stateless person who received the status of the refugee in the Azerbaijan Republic;

8.9. certificates on state registration of acts of civil status;

8.10. identity certificate of the seaman;

8.11. personal certificates (persons) of the military personnel;

8.12. certificates on state registration of legal entities;

8.13. car driver licenses;

8.14. the powers of attorney certified in notarial procedure;

8.15. the forms reflecting in themselves series and number of the documents specified in Items 8.1-8.14.

9. Inclusion in the state register and other documents can be provided by the legislation.

10. Data on documents join in the state register in the following cases:

10.1. when losing the document;

10.2. in case of cancellation of the document;

10.3. in case of non-presentation of the document which is subject to representation:

10.3.1. at deaths door owner of the document;

10.3.2. when changing by the owner of the document of condition of nationality;

10.3.3. when changing by the owner of the document of name, surname or middle name;

10.3.4. after document effective period;

10.4. when entering into the text of the document of illegal changes;

10.5. in other cases forming the basis for loss by the document of force.

11. For ensuring completeness of the State register the authorities specified in Item 8 of this provision transferring documents (further - authorities), transfer all subject to inclusion in the State register and stipulated in Item the 18th this provision of the data in the database of the State register by means of special system of data transmission in day of receipt of data on loss by the document of force. In the absence of this system, the data go the official letter signed by the head of authority.
