About features of provision and use of rent housing
For the purpose of creation of additional terms for ensuring separate categories of citizens with rent housing, and also increase in efficiency of its use:
1. Determine that district, city executive committees, regional, Minsk city executive committees in case of construction of apartment apartment houses of standard consumer qualities by them at the expense of the means specified in part two of Item 2 of article 110 of the Housing code of the Republic of Belarus having the right to determine that such apartment houses (their part) intend for accommodation of citizens of the most demanded positions of employees (professions of workers) on terms of the contract of hiring of rent housing.
Lists of the most demanded positions of employees (professions of workers) annually affirm district, city executive committees in coordination with bodies for work, employment and social protection, other interested structural divisions of regional executive committees performing state powers of authority in the respective sphere (area) of the state activities, the Minsk city executive committee.
Rent housing of municipal housing stock is provided to citizens of the most demanded positions of employees (professions of workers) for employment relationships based on decisions of district, city executive committees, administrations of districts of Minsk.
At the same time the specified citizens on condition of absence at them, and also members of their families to whom together with these citizens rent housing, other premises in property (share in the right of common property to premises) and (or) in ownership and use in the settlement on place of employment, except for the premises occupied by them according to the employment contract of premises in the hostel (is provided in case of realization of the right to provision of rent housing in Minsk or settlements of the Minsk district – in Minsk and settlements of the Minsk district) have the first-priority right to provision of such rent housing.
Provision of rent housing to citizens of the most demanded positions of employees (professions of workers) is performed by district, city executive committees, administrations of districts of Minsk according to the lists created based on individual petitions of state bodies and the organizations with which these citizens consist in employment relationships (further – individual petitions), on first come of such petitions.
After satisfaction of individual petitions concerning citizens of the most demanded positions of employees (professions of the workers) who are provided with such housing in first-priority procedure, rent housing is provided to other citizens of the most demanded positions of employees (professions of workers). At the same time the citizens staying on the registry of the housing conditions needing improvement have the privilege to its provision.
The amount of payment for use of rent housing by its provision according to the procedure and on the conditions established in this Item is determined:
to the citizens of the most demanded positions of employees (professions of workers) specified in part four of this Item according to parts three, the fifth and sixth Item 2 of article 31 of the Housing code of the Republic of Belarus;
to other citizens of the most demanded positions of employees (professions of workers) according to part three of Item 2 of article 31 of the Housing code of the Republic of Belarus.
The exempted rent housing in the apartment houses specified in part one of this Item is subject to provision to other citizens of the most demanded positions of employees (professions of workers), and in case of lack of individual petitions – to the citizens having the right to provision of rent housing according to the housing legislation.
The share of the built housing of the municipal housing stock intended for provision to citizens of the most demanded positions of employees (professions of workers) on terms of the contract of hiring of rent housing is annually determined regional, Minsk city by executive committees based on petitions of district, city executive committees, administrations of districts of Minsk.
1-1. The rent housing of republican and municipal housing stock located in settlements with population to 20 thousand people (except for settlements of the Minsk district), provided for employment relationships to the citizens belonging to the category of the most demanded positions of employees (professions of workers) is transferred to the possession of these citizens according to the procedure, determined in appendix.
2. Grant the right to district, city executive committees, administrations of districts of Minsk in coordination with regional, Minsk city executive committees based on relevant decisions not to levy payment for use of the rent housing of municipal housing stock provided to citizens according to items 4 and the 5th article 112 of the Housing code of the Republic of Belarus and requiring repair * on condition of accomplishment of repair with the consent of these citizens at the expense of own means.

* For the purposes of this Decree repair is understood as running repair of premises, installation, replacement and repair of the intra room electric, gas, sanitary and other equipment which failed in use (except for systems of central heating, system of antismoke protection and the automatic fire alarm), devices of individual accounting of consumption of water, heat and electrical energy, gas, intra room electrical wiring.
Coordination of the drafts of decisions of district, city executive committees specified in part one of this Item, administrations of districts of Minsk is performed regional, Minsk city by executive committees in ten-day time from the date of receipt of such drafts of decisions.
The payment for use of rent housing in case of accomplishment of repair of rent housing at the expense of means of citizens is not levied:
in case of accomplishment of repair according to the estimate approved by the state organizations in economic maintaining or operational management of which there are premises (taking into account the written consent specified in part four of this Item, when replacing work types and (or) materials), in the amount of, not exceeding estimated cost on each work type and materials;
after confirmation no later than six months from the date of the conclusion of the employment contract of rent housing of the repair work performed according to the estimate (taking into account the written consent specified in part four of this Item, when replacing work types and (or) materials) reflected in the act of reception-transmission in ownership and use of premises, and also their payments if repair of rent housing was made with involvement of other persons on contractual conditions;
during the period determined in proportion to the repair price specified in the estimate.
