About procedure for application of resolutions of the Plenum of the Supreme Court of Turkmenistan in connection with enforcement of the new Criminal code
Due to the enforcement since January 1, 1998 of the new Criminal code of Turkmenistan and for the purpose of ensuring application of the existing resolutions of the Plenum of the Supreme Court of Turkmenistan, the Plenum of the Supreme Court of Turkmenistan
decides:

The explanations containing in the existing resolutions of the Plenum of the Supreme Court of Turkmenistan after December 31, 1997 are applied in that part which do not contradict the new Criminal code and with observance of requirements of the principle about retroactive effect of the penal statute.
2. Judicial board on criminal cases of the Supreme Court of Turkmenistan, velayatsky and Ashgabat city to courts, exercising judicial supervision behind activities of subordinate courts, to give them practical help in the correct application of the new penal statute and in case of detection of miscarriages of justice to take timely measures for their elimination.
