Based on the paragraph of the eighth subitem 1.1 of Item 1 of the Presidential decree of the Republic of Belarus of August 26, 2024 No. 335 "About rendering services of cellular mobile telecommunication", subitem 6.1 of Item 6 of the Regulations on the Ministry of Communications and Informatization of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of March 17, 2004 No. 302, the Ministry of Communications and Informatization of the Republic of Belarus DECIDES:

1. Approve Regulations on procedure for forming of cost of services of cellular mobile telecommunication it (is applied).

2. This resolution becomes effective after its official publication.

Regulations on procedure for forming of cost of services of cellular mobile telecommunication

Chapter 1. General provisions

1. This Provision establishes procedure for forming of cost for the purposes of pricing of the following services of cellular mobile telecommunication within networks of telecommunication in the territory of the Republic of Belarus (further - services of cellular communication):

telephone service;

data service;

service of transfer of SMS messages.

Action of this provision does not extend to supplementary services of cellular communication, reference services, the services of mailings of SMS messages rendered with use of unique codes of identification, service of interaction of networks of cellular mobile telecommunication (interconnect).

2. Action of this provision extends to the operators of cellular mobile telecommunication rendering services of cellular mobile telecommunication is direct to the population (further - the operator of telecommunication).

3. For the purposes of this provision terms and their determinations in the values established by the Law of the Republic of Belarus of July 19, 2005 No. 45-Z "About telecommunication", the Rules of rendering services of telecommunication approved by the resolution of Council of Ministers of the Republic of Belarus of August 17, 2006 No. 1055 are applied.

4. For the purposes of planning of cost and forming of subscriber rates of service of cellular communication it is allowed to combine:

in groups of homogeneous services with identical type of traffic;

in groups of different services by the form traffic.

5. Selection of the expense amounts attributable to cost of groups of the services determined in part one of Item of 1 this provision from the total amount of expenses of the operator of telecommunication is performed according to the local legal act of the operator of telecommunication concerning pricing.

Chapter 2. Procedure for forming of cost of services of cellular communication

6. Services of cellular communication represent single engineering procedure in which the same production resources of communication participate in creation of different services and vice versa, it is allowed to involve resources of different production structures of the operator of telecommunication in creation of one service.

7. Costs of services of cellular communication are included the following cost types:

the direct production costs connected with rendering services of cellular communication which directly belong on cost of specific service or group of services;

the distributed costs connected with production of several services which part joins in cost of certain service of cellular communication according to the procedure, established in the local legal act of the operator of telecommunication concerning pricing;

superimposed costs - costs for realization and the general business costs which are not connected directly with production of specific type of service, but necessary for ensuring activities (functioning) of the operator of telecommunication.

The direct production costs relating to group of services are subject to distribution to specific services by the methods applied to the distributed costs.

8. Treat direct production costs:

the salary and fees (assignments) on social insurance of the personnel directly involved in rendering specific service of cellular communication (group of services);

cost of service of access to single network of cellular mobile telecommunication in LTE (4G) technology for rendering telecommunication of data service by operators to subscribers;

the cost of service in traffic transmission between networks of operators of telecommunication;

payment for use of radio-frequency range:

the cost of service in ensuring operational readiness of radio-frequency range for radio-electronic means of civil assignment;

the cost of service in the organization of ports and to provision in use of communication links of other operator of telecommunication;

the cost of service in provision to operators of telecommunication of access to the international data communication networks, including to segment of global computer network the Internet;

cost of service in provision of access to point of exchange of national traffic;

the cost of the access cards used for connection of the subscriber;

the cost of services of banks and non-bank credit and financial organizations for transfer of money in case of acceptance of subscriber payments for benefit of operators of telecommunication (commission fee);

maintenance costs of objects of network of cellular mobile telecommunication and information systems, including the software;

other costs which are directly connected with rendering services of cellular communication.

The direct production costs attributable to the specific services of cellular communication specified in part one of Item of 1 this provision are determined by the operator of telecommunication in the local legal act concerning pricing.

9. Treat the distributed costs:

the salary and fees (assignments) on social insurance of the personnel involved in rendering several services of cellular communication;

the cost of spare parts and consumable materials for repair of the equipment, tools, devices, stock, economic accessories, the special equipment, special (protective), uniform and corporate clothes;

charged depreciation and repair costs of the fixed assets used for rendering services of cellular communication, depreciation of intangible assets;
