About procedure for calculation of length of service for appointment and issue of pensions to faces of officers, to ensigns, warrant officers, the military personnel of the active extra urgent military service, faces of the commanding and ordinary structure of law-enforcement bodies, justice, customs, migrations, on emergency situations and their families

According to the Law of the Azerbaijan Republic "About work pensions" the Cabinet of Ministers of the Azerbaijan Republic decides:

1. Determine that in length of service for award of pension to faces of officers, ensigns, warrant officers, the military personnel of the active extra urgent military service, faces of the commanding and ordinary structure of law-enforcement bodies, justice, customs, migrations, on emergency situations and their families the following is set off:

• active duty in the Azerbaijani Army, and in other paramilitary groups created according to the legislation of the Azerbaijan Republic;

• service in positions of officers, ensign and serviceman of the active extra urgent military service in Service of state security of the Azerbaijan Republic, Service of foreign intelligence of the Azerbaijan Republic, the State Border Service, Public service on mobilization and conscription - from the date of position assignment;

• service in positions ordinary, younger, average, the senior and highest commanding structure in law-enforcement bodies, justice, on emergency situations - from the date of position assignment;

• from the date of appointment to service to positions of younger structure, average, the senior, highest commanding structure of customs authorities;

• from the date of appointment to service to positions younger, average, the senior, highest commanding structure of migratory service;

• the stay period under guards, in places of restriction of freedom and in organizations of serving sentence of the military personnel, faces of the commanding and ordinary structure of law-enforcement bodies, on emergency situations, justice, customs and the courier communication, by the legislation of the Azerbaijan Republic having the right to compensation of the damage caused by mistake or abuse of the body performing criminal procedure;

• the work period in the civil ministries, head departments, the companies and the organizations, remaining on active duty, in personnel structure of judicial authorities, and on emergency situations;

• the period of participation in combat operations in fighting situation, and also stay term in captivity, environment in case of accomplishment of conscription in Afghanistan if captivity was not voluntary and if the serviceman, being in captivity, did not commit crime against the republic;

• service of the armed forces of highly qualified officer personnel which are in inventory - pensioners in the Azerbaijani Army, in bodies, the Ministries of Internal Affairs, the Ministry of Emergency Situations, the Ministries of Justice, Services of state security, Service of foreign intelligence, the State Customs Committee, the Public migratory service, Public service on mobilization and conscription and the State Border Service. Upon termination of this term pension is subject to recalculation by the current legislation.

In case of award of pension to faces of officers, average, the senior, highest commanding structure of law-enforcement bodies, customs, on emergency situations, Penitentiary and health service of the Ministry of Justice based on Item 9.5.1 of the Law of the Azerbaijan Republic "About work pensions" the length of service joins also time of their training in civil highest educational institutions, and also in the average special educational institutions having rates and departments of military preparation including in evening departments the highest educational institutions and in absentia educations before their acceptance on active duty and to positions of the private and the commanding structure in law-enforcement bodies, at the rate of one year of training is set off in six months within five-year term.

If these persons, being students, not having ended training, directly from the highest civil educational institution arrived in the highest educational institutions of special purpose for education continuation, training term in the highest civil educational institutions is set off in length of service on the same bases.

For the employees discharged from office in the supreme bodies of the government and who continued service in law-enforcement bodies, the period of service in these bodies is set off in office years of service.

For the employees recovered on service in law-enforcement bodies based on the article 148 "Regulations on Service in Law-enforcement Bodies of the Azerbaijan Republic", the period from the date of dismissal from law-enforcement bodies about day of signing of the order on recovery on service is set off in years of service of continuous service.

In case of award of pension to the staff of penitentiary and medical services of judicial authorities the period worked as civilians in the penal institutions and medical institutions provided for the imprisoned persons is set off in office years of service.

In case of revenues to service in judicial authorities and migrations the office years of service of persons working earlier at the positions connected with coordination of activities of law enforcement agencies, the legislation or organizational support are set off in office years of service in judicial authorities and migration.

The working life of the military personnel chosen from number of highly qualified specialists and accepted on military service in subjects of prospecting and counterintelligence activities before acceptance on military service joins in long-term service at the rate of two days in one day.

1-1. Before transfer of the Public courier service under the Cabinet of Ministers of the Azerbaijan Republic in subordination of Special service of the state protection of the Azerbaijan Republic, years of service which her employees have is taken into account when calculating time of long-term service for appointment to specified persons of pension.

2. For award of pension to faces of officers, ensigns, warrant officers, the military personnel of the active extra urgent military service, faces of the commanding and ordinary structure (having pension entitlement) law-enforcement bodies and justice in length of service the following is on favorable terms set off:

a) one month of service is set off in two months:

• the term of continuous stay in clinics as a result of mutilation (wounds, injuries, contusions), or the diseases got in combat operations in fighting situation;

• in mountain areas of the republic at the height of 2500 meters from sea level above;

• flight works in jet and turbo-propeller aircraft - on the bases established by the Ministry of Defence;

• on positions of the submariners conducting work under water or in pressures chamber in the conditions of high pressure long time - on the bases established by the Ministries of Defence and Internal Affairs, and also the State Border Service.

b) one month of service is set off in one and a half months:

• on positions of submariners of all names and categories (except the submariners specified in the subitem "b" of Item 2 of this resolution);
