1. Approve "Export regimes to the certain states of goods (the works, services, results of intellectual activities) falling under export control", "Rules of implementation of export control", "The list of the executive bodies exercising export control according to the nomenclature of the goods falling under export control, and also issuing special permission on categories and Sections of goods (works, services, results of intellectual activities) for the inventory (works, services, results of intellectual activities) performing check before issue of special permission, control of use of dual-use goods for stated purposes", "Rules of issue of special permission to the goods (works, services, results of intellectual activities) falling under export control" determined by the legislation "The procedure for conducting checks before issue of special permission to implementation of foreign economic relations on goods (works, services, results of intellectual activities) falling under export control", "Procedure of control of use of goods (works, services, results of intellectual activities) of dual purpose for stated purposes" (is applied).

2. This resolution becomes effective from the date of signing.

Customs procedures of export to the certain states of the goods (works, services, results of intellectual activities) falling under export control

1. This normative legal document is prepared according to the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About export control" of December 29, 2004 No. 167 and determines export regimes to the certain states of the goods (works, services, results of intellectual activities) falling under export control. Accomplishment of the customs procedures of commodity export (works, services, results of intellectual activities) falling under export control is obligatory for all persons.

2. Commodity export (works, services, results of intellectual activities), falling under export control, to the states on which the ban and restriction, to end users, including use of the territory of the Azerbaijan Republic as the transit country is imposed is not allowed.

3. If the goods (works, services, results of intellectual activities) falling under export control are provided by the bilateral or multi-lateral international treaties signed by the Azerbaijan Republic with the certain states and approved by the relevant laws of the Azerbaijan Republic, the external economic transactions on these goods are performed according to article 2.2 of the Law of the Azerbaijan Republic "About export control".

4. Transportation on the territory of the country is not allowed, using as transit the territory of the Azerbaijan Republic, and also in opposite direction, the goods (works, services, results of intellectual activities) affecting national security of the Azerbaijan Republic.

5. According to provisions of the agreements "About Non-proliferation of Nuclear Weapon", "About Comprehensive Nuclear Test Ban" which the Azerbaijan Republic joined the relevant laws carrying out with any state of the external economic transactions on goods (works, services, results of intellectual activities) which can be used in creation, transportation of weapons of mass destruction is not allowed.

6. According to the provisions "Agreements on Application of Guarantees in connection with the Nuclear Non-Proliferation Treaty between the Azerbaijan Republic and the International Agency on Nuclear Power and the Protocol Attached to It", approved by the relevant laws of the Azerbaijan Republic, and Provisions of the Charter of the International Agency on nuclear power which it joined, the external economic transactions on goods (works, services, results of intellectual activities) falling under export control which use of atomic energy is provided only in the peace purposes, can be performed according to the legislation of the Azerbaijan Republic.

7. According to the provisions "Conventions on Prohibition of Production, Production, Building-up and Use of Chemical Weapon and Its Liquidation" which the Azerbaijan Republic the relevant law joined control of the external economic transactions on chemicals, depending on specific weight in their composition of mixes, is exercised by the carried-out State Parties and not participants of this Convention.

8. According to the provisions "Conventions on Prohibition of Development, Production and Stock Accumulation of Bacteriological (Biological) and Toksinny Weapon and on Their Destruction" which the Azerbaijan Republic the relevant law joined implementation of the external economic transactions on dual-use goods which can be perhaps used in development, production of the specified weapon with the State Parties and not participants of this Convention, can be performed if on determination of the specified goods the guarantee is given and control according to requirements of the Convention is exercised.

9. The external economic transactions with the goods falling under export control can be performed on condition of ensuring national security, political, military and economic interests of the certain states and the Azerbaijan Republic, observance of obligations of interstate international treaties on nonproliferation and other types of weapon which the Azerbaijan Republic joined.
