The government of the Republic of Kazakhstan, the Government of the Kyrgyz Republic and the Government of the Republic of Uzbekistan which are hereinafter referred to as - the Parties, being guided by intentions to jointly perform measures for prevention of possible environmental pollution by toxic, radioactive waste of the tailings dams and dumps located in the territory of the Parties agreed as follows:

Article 1

The parties came to the agreement of need of assessment of real danger from possible destruction of tailings dams and dumps of rocks in connection with adverse climatic and hydroweather conditions, designing of preservation and liquidation of tailings dams, and also works on recultivation of dumps.

Article 2

The parties will create interstate coordination working group of the specialists, having charged it determination of specific types, methods and amounts of researches, terms of performance of works, first of all in the territory of the Kyrgyz Republic.

Article 3

Expenses of the Parties will be determined by projects on accomplishment of these works by liquidation of tailings dams and recultivation of dumps.

Consider it expedient to inform on the planned works the Russian Federation and ask it to take part in the solution of the considered problems.

Article 5

Considering that the Fergana Valley and its mountain frame in the ecological relation represent the single region, and possible environmental pollution by toxic, radioactive waste of the tailings dams and dumps located in its territory constitutes equivalent danger to the State Parties, to consider expedient carrying out joint operations by the Parties on creation of the single territorial scheme of environmental protection and environmental management of this region. This agreement becomes effective from the date of its signing.

It is made in Tashkent on April 5, 1996 in one authentic copy in Russian.

The authentic copy is in Executive committee of Interstate Council of the State Parties which sends to each state which signed this agreement, its verified copy.
