This Law determines legal, organizational and economic basis of social entrepreneurship, is aimed at providing the state guarantees of protection, the state support and expansion of activities of the subjects of social entrepreneurship arising during its realization.

Chapter 1. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

1) social entrepreneurship – the business activity directed to support of socially vulnerable segments of the population and performed according to this Law for delivery of goods, performance of works and rendering services of social appointment;

2) the social company – the legal entity performing activities in the sphere of social entrepreneurship, included in the register of subjects of social entrepreneurship according to the procedure, established by this Law;

3) the social entrepreneur – the individual entrepreneur included in the register of subjects of social entrepreneurship according to the procedure, established by this Law;

4) the register of subjects of social entrepreneurship – the single database about the social companies and social entrepreneurs which maintaining performs authorized state body on state registration of legal entities and individual entrepreneurs;

5) socially vulnerable national groups – the persons which are in difficult life situation, experiencing difficulties in social adaptation and needing the help;

6) the social project – method of support of the independent social business activity realized by subjects of social entrepreneurship;

7) goods of social appointment – thing and the means necessary for creation of opportunities for socially vulnerable national groups, equal with other citizens, including prosthetic and orthopedic products and stock, and also the rehabilitation face equipment with limited opportunities, books and other printing editions with Braille's font, educational and fiction for children with limited opportunities, audio-books, and also video records using sign language and others;

8) social services – the services rendered in the forms established by the legislation of the Republic of Tajikistan to socially vulnerable national groups and also services in prosthetics and repair of prosthetic and orthopedic products and stock for persons with disability, medical, social and employment rehabilitation of persons with disability and mental problems, training of the children with disability who do not have opportunity to visit educational institutions at home, work therapy of persons with mental disturbances and limited opportunities, the services in training in their new professions and others realized according to this Law;

9) social innovations – the new ideas, strategy, new technologies promoting the solution of social problems.

Article 2. Legislation of the Republic of Tajikistan on social entrepreneurship

The legislation of the Republic of Tajikistan on social entrepreneurship in the Republic of Tajikistan is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by Tajikistan.

Article 3. Purpose of this Law

The purpose of this Law is providing guarantee of the state protection, the state support and expansion of activities of subjects of social entrepreneurship, and also assistance in improvement of quality of life and assistance to socially vulnerable national groups, the solution of social problems, achievement of the socially useful purposes, creation of favorable economic environment for social entrepreneurship and implementation of social innovations.

Article 4. Tasks of the sphere of social entrepreneurship

Tasks of the sphere of social entrepreneurship are:

1) development of the sphere of social services;

2) ensuring participation of subjects of entrepreneurship and the public in the solution of social problems, including by implementation of social innovations and assistance in rendering social services, the predusmotrennykhnastoyashchy Law;

3) creation of new workplaces for socially vulnerable national groups and providing for them opportunities for participation in socially useful activities, equal with other persons;

4) assistance of professional orientation and to employment, including, employment of socially vulnerable national groups;

5) promotion on the market of the made goods, the performed works, the rendered services of social entrepreneurship by subjects, including by personal labor participation of socially vulnerable national groups.

Article 5. Principles of social entrepreneurship

Social entrepreneurship is based on the following principles:

1) legality;

2) social justice;

3) priority of public concerns;

4) transparency of activities of subjects of social entrepreneurship;

5) voluntariness of social entrepreneurship;

6) equality of subjects of social entrepreneurship;

7) security of protection of the rights and ensuring free activities of subjects of social entrepreneurship by the state.

Article 6. Guarantee of implementation of social entrepreneurship

The state recognizes and permits to perform any kinds of the social entrepreneurship directed for the problem resolution and support of socially vulnerable national groups, realization and (or) deliveries of goods of social appointment, and also the rendering services for socially vulnerable national groups which is not contradicting the legislation of the Republic of Tajikistan, except for activities for production and (or) realization of excise goods, to traffic in weapons and the main parts of firearms, and also activities for production and (or) realization of minerals (except for popular minerals).

Article 7. Subjects of social entrepreneurship

Subjects of social entrepreneurship are the individual entrepreneurs and legal entities who are performing social business activity, and received the status of the social company or the social entrepreneur according to the procedure, established by this Law.

Article 8. Socially vulnerable national groups

1. Treat socially vulnerable national groups:

1) disabled people and other persons with limited opportunities, including handicapped children and their families;

2) minor orphans, minor children without parental support, graduates of orphanages (aged up to twenty three years), and also the minors which are in socially dangerous environment;

3) pensioners and persons who to retirement on age had two years, the elderly people who in parts or in full lost capability to self-service, living alone faces, including living alone married couples;

4) the persons which appeared in difficult life situation and needing temporary shelter or urgent social servicing;
