Chapter 1. General provisions

Article 1. Subject of regulation of this Federal Law

This Federal Law governs the relations arising between the subjects performing forming of technological policy in the Russian Federation and persons performing assistance to development of technologies.

Article 2. Legal regulation in the field of technological policy in the Russian Federation

Legal regulation in the field of technological policy in the Russian Federation is based on the Constitution of the Russian Federation and the Federal constitutional Laws, is performed according to this Federal Law, other Federal Laws, other regulatory legal acts of the Russian Federation and regulatory legal acts of subjects of the Russian Federation and bodies of the public power of the federal territories.

Article 3. The basic concepts used in this Federal Law

For the purposes of this Federal Law the following basic concepts are used:

1) agents of development of technologies - institutes of innovative development and other legal entities performing financing of projects of development of technologies at the expense of means which source of financial provision are means of budgets of budget system of the Russian Federation;

2) high-technology products, high-technology results of works and rendering high-technology services in the field of development of technologies (further - high-technology products) - the goods developed and made on the basis of critical and (or) end-to-end technologies with use of the advanced scientific and technical achievements and innovative methods, works and services in the field of development of technologies. The list of types of high-technology products affirms the Government of the Russian Federation;

3) the card of technological cooperation - the organizational chart of implementation of technologies, including forming of own lines of development of technologies;

4) the skilled customer - the Russian legal entity providing long-term demand for the high-technology products created including within realization of instruments of realization of technological policy. The skilled customer can be the buyer (customer) of such products;

5) critical technology - the high technology necessary for creation of the high-technology products having system value for functioning of economy, the solution of social and economic tasks, ensuring defense of the country and safety of the state;

6) measures of the state stimulation of sales activity of technological policy in the Russian Federation (further - measures of the state stimulation) - legal, economic and organizational measures which are applied in the field of development of technologies at the expense of means of budgets of budget system of the Russian Federation and are directed to goal achievement of technological policy in the Russian Federation;

7) the organization with the state participation - the Russian Federation and (or) the subject of the Russian Federation included in the list of the organizations with the state participation realizing programs of innovative development, the legal entity whose founders are the Russian Federation and (or) the subject of the Russian Federation approved by the Government of the Russian Federation and (or) concerning which have the right to dispose directly or indirectly of more than 50 percent of total quantity of the voices falling on voting shares (shares) constituting the authorized capital of such legal entity, strategic joint-stock company, and also affiliated economic society of such organizations in which such organizations have the right directly or indirectly to dispose of more than 50 percent of total quantity of the voices falling on voting shares (shares) constituting the authorized capital of affiliated economic society;

8) projects of development of technologies - national projects on ensuring technological leadership of the Russian Federation, and also projects on development of end-to-end technologies and other projects on creation of high-technology products and implementation of technological innovations which are not national projects on ensuring technological leadership of the Russian Federation;

9) the producer of high-technology products - the legal entity or the individual entrepreneur performing implementation of technologies and technological innovations and (or) creation and realization of high-technology products;

10) end-to-end technology - the perspective high technology (direction) of cross-industry value which is providing creation of high-technology products and (or) implementation of technological innovations, having significant effect on economic development by change of the markets and (or) assistance to forming of the new markets;

11) own line of development of technologies - complex of actions (projects, programs) and conditions (including availability of personnel potential, results of researches and developments, technical documentation, programs for electronic computers (further - the computer programs), the rights to results of intellectual activities, fixed assets and other property) which implementation and accomplishment provide creation and sustainable development of domestic technologies and products on their basis, including development of their new generations, in the territory of the Russian Federation or in the cases established by the Government of the Russian Federation beyond its limits with preserving control of the Russian Federation or the Russian legal entities (further - national control);

12) technological innovations - new or advanced product (in particular, the device, substance, microorganism strain, culture of cages of plants or animals), method or production process (realization) of goods, performance of works, rendering services, the creations of the protected results of intellectual activities put into practice and promoting forming of the new markets, and (or) work performance improvement, and (or) increase in technical and economic indicators of the made products;

13) technological policy in the Russian Federation (further - technological policy) - complex of legal, economic, organizational and other measures on ensuring technological leadership of the Russian Federation and economic development on the basis of domestic technologies;

14) technological leadership of the Russian Federation - the technological independence of the Russian Federation which is expressed in development of domestic technologies and creation of products with use of such technologies with preserving national control over critical and end-to-end technologies on the basis of own lines of development of technologies for the purpose of export of competitive high-technology products and (or) substitution by it in the domestic market of products created based on obsolete and (or) foreign technologies and also superiority of such technologies and products over foreign analogs;

15) technology - set scientifically and almost reasonable methods, means, transactions and (or) processes necessary for transformation of energy, substance, information for the purpose of production of one or several types of products, performance of works, rendering services.

Article 4. Purposes and tasks of technological policy

1. The purposes of technological policy are:

1) ensuring technological leadership of the Russian Federation;
