ORDER OF THE MINISTRY OF INTERNAL AFFAIRS OF UKRAINE

About approval of the Procedure for declaring of firearms and ammunition to it

(as amended of the Order of the Ministry of Internal Affairs of Ukraine of 21.11.2024 No. 778)

According to part six of article 1-2 of the Law of Ukraine "About ensuring participation of civilians in protection of Ukraine", the paragraph of third Item 3 of the Section II "Final and transitional provisions" of the Law of Ukraine of August 20, 2024 No. 3899-IX "About introduction of amendments to the Law of Ukraine "About ensuring participation of civilians in protection of Ukraine" concerning enhancement of procedure for obtaining, declaring and the handling of firearms", for the purpose of determination of the mechanism of declaring of firearms and ammunition to it PRIKAZYVAYU:

1. Approve the Procedure for declaring of firearms and ammunition to it which is applied.

2. Of the Ministry of Internal Affairs of Ukraine (Grintsov M.) to provide to department of interaction with National police of Ukraine submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. This order becomes effective from the date of enforcement of the Law of Ukraine of August 20, 2024 No. 3899-IX "About introduction of amendments to the Law of Ukraine "About ensuring participation of civilians in protection of Ukraine" on enhancement of procedure for obtaining, declaring and the handling of firearms", but not earlier than day of official publication of this order.

Procedure for declaring of firearms and ammunition to it

1. This Procedure determines the mechanism of declaring by citizens of Ukraine, foreigners, stateless persons which on legal causes are in the territory of Ukraine (further - civilians) received, found them during action of warlike situation of firearms with rifle barrel of caliber to 12,7 of mm, smooth-bore weapon of caliber to 23 mm (further - firearms) and ammunition to it (further - ammunition) in territorial authorities of National police of Ukraine and their territorial (isolated) subdivisions (further - bodies (divisions) of police) if such person showed willingness to leave the found firearms and ammunition to it for action of warlike situation.

2. The civilian who found firearms and ammunition shall report immediately about such fact according to telephone number of the emergency service 102 or single telephone number 112 and within 24 hours to report them to the authorities (divisions) of police by any convenient method for further delivery or declaring or to specify their location for further withdrawal.

Firearms in not loaded condition and ammunition is transported for delivery or declaring is hidden from other persons. Dismantling of firearms and ammunition and/or demonstration, except the official of body (division) of police, is forbidden to his other persons.

3. Declaring of firearms and ammunition is performed based on the written application of the civilian in the form given in appendix 1 to this Procedure (further - the statement), the police which is personally given to body (division) in the place of its declared/registered residence (stay), with simultaneous presentation of the identity document determined by part one of article 13 of the Law of Ukraine "About the Unified state demographic register and documents confirming citizenship of Ukraine, proving the identity or her special status" or the passport document of the foreigner (further - the identity document) and the firearms and ammunition which are available for it.

Circumstances of obtaining, finding of firearms and ammunition, the place of their storage and reasons for need of further ownership and use are specified by them in the statement if such person showed willingness to leave the found firearms and ammunition to it for action of warlike situation.

4. Are enclosed to the application:

1) copy of the identity document;

2) the statement from the register of territorial community about the declared/registered residence (stay);

3) one photograph 3,5 size * centimeter 4,5;

4) the copy of the document on assignment of registration number of accounting card of the taxpayer, except physical persons which because of the religious beliefs refuse adoption of registration number of accounting card of the taxpayer according to the law;

5) the copy of the document (certificate) confirming passing by the civilian of military service, service in law enforcement agencies, work in the public authorities having the right to storage and carrying firearms, or other document (certificate) confirming experience of use of firearms or belonging to security forces and forces of defense or participation in fighting (in the presence).

5. The civilian in case of filing of application transmits to the official of body (division) of police the received, found firearms and ammunition for carrying out their identification, fixing through the means having functions of photo - or videos.

6. The data containing in the statement are registered in the information and communication system "Information Portal of National Police of Ukraine" (further - the INNP system) according to Procedure for conducting the single accounting in bodies (divisions) of police of statements and messages on criminal offenses and other events approved by the order of the Ministry of Internal Affairs of Ukraine of February 08, 2019 No. 100, registered in the Ministry of Justice of Ukraine on March 05, 2019 under No. 223/33194, as event about voluntary surrender of firearms and ammunition for the purpose of declaring. The application is considered within a day from the date of its giving in body (division) of police.

7. The body (division) of police checks the civilian on information resources of the INNP system for the purpose of establishment of availability/lack of the circumstances interfering declaring of firearms and ammunition, in particular data about:

1) systematic (two times or more) violation by the civilian of public (public) order (attraction two times or more within year to the administrative responsibility under article 173 of the Code of Ukraine about administrative offenses (further - KUOAP);
