For the purpose of implementation of Articles 6, 7 Laws of the Kyrgyz Republic "About halalas industry in the Kyrgyz Republic", according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve the Procedure for carrying out and realization of system of certification, marking of products and services on compliance to standards of "halalas" and its mutual recognition between the countries according to appendix.

2. Declare invalid:

1) the order of the Government of the Kyrgyz Republic "About questions of realization of system of voluntary certification, marking of products and services on compliance to standards of "Halalas" in the territory of the Kyrgyz Republic" of September 12, 2017 No. 554;

2) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic "About questions of realization of system of voluntary certification, marking of products and services on compliance to standards of "Halalas" in the territory of the Kyrgyz Republic" of September 12, 2017 No. 554" of December 29, 2022 No. 719.

3. This resolution is subject to official publication and becomes effective from the date of entry into force of part 2 of article 6 of the Law of the Kyrgyz Republic "About halalas industry in the Kyrgyz Republic".

Procedure for carrying out and realization of system of certification, marking of products and services on compliance to standards of "halalas" and its mutual recognition between the countries

Chapter 1. General provisions

1. The procedure for carrying out and realization of system of certification, marking of products and services on compliance to standards of "halalas" and its mutual recognition between the countries establishes the legal basis in the sphere of carrying out certification and marking of products and services of "halalas", and also the procedure of its mutual recognition between the countries (further - the Procedure).

2. Electronic interaction between authorized bodies, certification bodies and participants of turnover in the sphere of halalas industries is performed by means of the State portal in the sphere of halalas industries of the Kyrgyz Republic (further - the State portal).

3. The authorized body in the sphere of development of halalas industries is authorized state body on maintaining the State portal.

4. The concepts used in this Procedure:

1) the State portal in the sphere of halalas industries of the Kyrgyz Republic - the single automated information system of accounting of traceability of the certified halalas products and services;

2) the applicant - the participant of turnover of halalas products and services directing the request for receipt of the certificate of conformity of "halalas" and QR code of marking;

3) marking is process of drawing unique two-dimensional bar code (QR code) on the certificate of conformity of "halalas", packaging of products or materials, authentic data on which also contain in the State portal;

4) certification bodies - legal entities - the residents of the Kyrgyz Republic performing activities for certification of halalas products and services;

5) regulations - the document on interaction of authorized bodies, certification bodies and participants of turnover in the sphere of halalas industries - in case of execution of the certificate of conformity of "halalas" within the State portal, approved by authorized state body;

9) authorized body in the sphere of development of halalas industries - the public institution authorized by the Cabinet of Ministers of the Kyrgyz Republic to enable the realization of policy in the sphere of development of halalas industries;

10) participants of turnover of halalas products and services - the physical persons and legal entities performing economic activity in the territory of the Kyrgyz Republic as the producer, the exporter, the seller or the importer of halalas products and services;

11) halalas products - products made according to requirements of technical regulations and standards on halalas products;

12) service halalas - the activities performed according to requirements of standards on service halalas.

Chapter 2. Procedure for carrying out certification of halalas products and services

5. Work on certification of halalas products and services is performed by accredited bodies on certification.

6. The certification bodies which obtained the international accreditation in such organizations as JAKIM (Malaysia), SMIIC (Turkey), Saudi Accreditation Center (Saudi Arabia) can be acknowledged in the Kyrgyz Republic according to Chapter 8 of this Procedure, on condition of their compliance to national requirements in the sphere of accreditation and confirmation by national authority for accreditation of the Kyrgyz Republic.

7. Certification bodies acquire the right to issue of certificates of conformity to standards of "halalas" through the State portal after agreement signature about use of this system by authorized body in the sphere of development of halalas industries.

8. Process of carrying out certification of halalas products and services is performed at the initiative of the applicant through the State portal according to this Procedure and the regulations approved by authorized body in the sphere of development of halalas industries.

9. For passing of procedures of certification of halalas products and services and receipt of the certificate of conformity of "halalas" participants of turnover of halalas products and services submit the application to certification body through the State portal.
