No. 160-164, 537), with subsequent changes, DECIDES: the Government

1. Create digitalization Agency in justice and judicial administration, the administrative authority subordinated to the Ministry of Justice, as a result of reorganization by merging (connection) of the Agency on administration of degrees of jurisdiction and the Agency of legal information resources.

2. Establish the extreme number of staff of the Agency on digitalization in justice and judicial administration in number of 63 established posts with the annual salary fund according to the legislation.

3. The digitalization agency in justice and judicial administration is successor of the rights and obligations of the Agency on administration of degrees of jurisdiction and the Agencies of legal information resources.

4. The property of the Agency on administration of degrees of jurisdiction and the Agency of legal information resources is transferred to digitalization Agency in justice and judicial administration according to the Regulations on procedure for cession of property of state-owned property approved by the Resolution of the Governments No. 901/2015.

5. Approve:

5.1. Regulations on the organization and functioning of the Agency on digitalization in justice and judicial administration, according to appendix No. 1;

5.2. Structure of the Agency on digitalization in justice and judicial administration, according to appendix No. 2;

5.3. To Organigramm Agentstva on digitalization in justice and judicial administration, according to appendix No. 3.

6. The staff of the Agency on administration of degrees of jurisdiction and the staff of the Agency of legal information resources will continue activities before approval of the number of staff of the Agency on digitalization in justice and judicial administration.

7. Before appointment as the Government of the director of the Agency on digitalization in justice and judicial administration, to the Minister of Justice to designate person who will temporarily take up this position.

8. To the Ministry of Justice within 6 months from the effective date this resolution:

8.1. make changes to the regulations according to this resolution;

8.2. provide to the Government of the offer on modification of regulations for the purpose of reduction them to compliance with this resolution.

9. To digitalization agency in justice and judicial administration within 12 months from the effective date this resolution:

9.1. carry out inventory count of the information resources and systems which are at its disposal or property;

9.2. provide registration by means of the Information system "Register of the State Information Resources and Systems" of the state information resources and systems which are at its disposal or, depending on circumstances, in property.

10. Make changes to some orders of the Government, according to appendix No. 4.

11. The order of the Government No. 650/2016 about the organization and functioning of the Agency on administration of degrees of jurisdiction (The official monitor of the Republic of Moldova, 2016, Art. No. 151-155, 718), with subsequent changes and the Order of the Government No. 644/2018 about the organization and functioning of the Agency of legal information resources (Official monitor of the Republic of Moldova, 2018, Art. No. 256-265, 704), with subsequent changes, to recognize invalid.

12. This resolution becomes effective since January 1, 2025.

Regulations on the organization and functioning of the Agency on digitalization in justice and judicial administration

Chapter I. General provisions

1. The regulations on the organization and functioning of the Agency on digitalization in justice and judicial administration (further - the Provision) regulate mission, spheres of activity, functions, obligations, the rights and procedure for the organization of activities of the Agency on digitalization in justice and judicial administration (further - the Agency).

2. The agency is the administrative authority subordinated to the Ministry of Justice, with the status of the legal entity of the public law located in municipium of Chisinau, having the name, seal with the image of the State Emblem of the Republic of Moldova, treasurer accounts, and also other details characteristic of bodies of the public power established by the legislation.

3. Financing and material logistics of the Agency is performed from the government budget and other sources which are not forbidden by the law.

4. The agency carries out the tasks in case of the strict observance of independence and other guarantees established for judicial system.

5. In areas of the activities the Agency cooperates with bodies and organizations of the public power, competent regulatory authorities, non-profit organizations and the international bodies.

Chapter II. Mission, competences, main functions and rights of the agency

6. The mission of the Agency consists in assistance to improvement of quality of public services in the sector of justice by upgrade, application, development and support of information technologies and information system management in the sphere of justice, and also ensuring organizational activities of degrees of jurisdiction.
