1. Approve Regulations on issue of the town-planning certificate in case of lack of town-planning documentation for rural settlements with the population less than 3 000 inhabitants (are applied).

2. This resolution becomes effective since January 30, 2025.

Regulations on issue of the town-planning certificate in case of lack of town-planning documentation for rural settlements with the population less than 3 000 inhabitants

Chapter I. General provisions

1. The regulations on issue of the town-planning certificate in case of lack of town-planning documentation for rural settlements with the population less than 3 000 inhabitants (further - the Provision) are established by procedure for issue of the information town-planning certificate and town-planning certificate for designing based on the scheme of rural town planning prepared according to the this provision provisions.

2. This Provision is applied in case of issue of the information town-planning certificate and town-planning certificate on designing in case of lack of town-planning documentation to rural settlements with the population less than 3 000 inhabitants, including the objects of national value located in rural settlements with the population less than 3 000 inhabitants if issuer of the above-stated documentation is the public organization "Bureau on Arrangement of the Territory, Town Planning, Construction and Housing", according to Regulations on procedure for issue of the town-planning certificate for designing and permission to construction/demolition for socially useful works of national value, the approved Order of the Government No. 489/2024.

3. The body of local public authority is responsible for decision making about development of town-planning documentation in full according to part (1) article 47 of the Town-planning and construction code No. 434/2023. In this case issue of allowing documentation on designing is performed in accordance with general practice.

4. In the absence of town-planning documentation for rural settlements with the population less than 3 000 inhabitants the beneficiary (owner)/superficiary notifies body of local public authority on intention to start wiring design of rural town planning. The body of local public authority within 15 days from the moment of receipt of the notification in writing informs the applicant on availability or lack of any restrictions, prohibitions or lack of the relevant information. After 15-day term from the date of submission of the notification if the investor did not receive motivated objections / restrictions / prohibitions or did not receive the answer to the notification, he has the right to start preparation of the scheme of rural town planning concerning which it submitted the notification.

5. The scheme of rural town planning is documentation with the leading and regulating component for planning and systematization of works on designing of construction on the separate parcels of land within rural settlements with the population less than 3 000 inhabitants who do not have town-planning documentation.

6. As the leading and regulating requirements in case of wiring design of rural town planning the basic researches developed according to the criteria provided in Chapters IV-VIII of this provision, the requirement of regulating documents in the sphere of construction and data of the analysis of the current situation for the purpose of priority providing public concerns and harmonious development of the settlement are used.

7. The structure and procedure for wiring design of rural town planning are similar to town-planning documentation like "Detailed town-planning plan", and also to requirements of this provision, except for references to provisions of town-planning documentation of higher procedure which cannot be applied in this case because of their absence.
