About questions of regulation of labor migration of foreign citizens and stateless persons in the Kyrgyz Republic

For the purpose of optimization of the procedures of document creation regulating procedure for stay in the territory of the Kyrgyz Republic of foreign citizens and stateless persons in pursuance of the Presidential decree of the Kyrgyz Republic "About measures for optimization of migratory processes in the Kyrgyz Republic" of September 19, 2024 268, according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides No.:

1. Approve Provisional regulations for procedure for execution of allowing documents for stay and implementation of labor activity in the territory of the Kyrgyz Republic by foreign citizens and stateless persons (further - Provisional regulations) according to appendix.

2. Establish effective period of Provisional regulations till January 1, 2026.

3. Suspend till January 1, 2026 the Regulations on procedure of labor activity foreign citizens and stateless persons in the territory of the Kyrgyz Republic approved by the order of the Government of the Kyrgyz Republic "About some questions in the sphere of labor migration in the Kyrgyz Republic" of April 16, 2019 No. 175.

4. Determine that the procedure for execution of the labor visa is performed according to the Provisional regulations approved by Item 1 of this resolution.

5. To the Ministry of Foreign Affairs of the Kyrgyz Republic for operation of Provisional regulations to realize functions on registration and issue of allowing documents for work to foreign citizens.

6. To the Ministry of Foreign Affairs of the Kyrgyz Republic, the Ministry of Finance of the Kyrgyz Republic and the Ministry of Labour, social security and migration of the Kyrgyz Republic to take the necessary measures following from this resolution.

7. To the Ministry of Foreign Affairs of the Kyrgyz Republic together with the Ministry of Labour, social security and migration of the Kyrgyz Republic:

1) to organize and carry out information and explanatory work among the population;

2) to ensure permanent advisory job in case of execution of allowing documents for foreign citizens and stateless persons according to Provisional regulations.

8. To the Ministry of Foreign Affairs of the Kyrgyz Republic to carry out the analysis of provision of service in execution of allowing documents for stay and implementation of labor activity in the territory of the Kyrgyz Republic by foreign citizens and stateless persons by the principle of "single window" according to Provisional regulations and to make offers in Administration of the President of the Kyrgyz Republic.

9. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

10. This resolution is subject to official publication and becomes effective since January 1, 2025.

Provisional regulations for procedure for execution of allowing documents for stay and implementation of labor activity in the territory of the Kyrgyz Republic foreign citizens and stateless persons

Chapter 1. General provisions

1. The provisional regulations for procedure for execution of allowing documents for stay and implementation of labor activity in the territory of the Kyrgyz Republic by foreign citizens and stateless persons (further - Provisional regulations) determine procedure for registration of the Single permission granting the right to stay and implementation of labor activity in the territory of the Kyrgyz Republic by means of the "Single window" integrated with the Elektronnaya Viza portal.

2. For stay in the territory of the Kyrgyz Republic for the purpose of implementation of labor activity the foreign citizen or the stateless person draws up Single permission within the established quotas for attraction and use of foreign labor power in the Kyrgyz Republic.

3. The authorized body in the sphere of migration in the procedure established by the legislation initiates the decision of the Cabinet of Ministers of the Kyrgyz Republic on limiting determination of number of quota for attraction and use of foreign labor power.

The authorized body in the sphere of migration carries out monitoring and the analysis of the domestic market of work taking into account social and economic changes based on data of the Single system of accounting of external migration (further - ESUVM).

4. In case of approval of annual quota for attraction and use of foreign labor power the following criteria are considered:

- the number of the foreign citizens and stateless persons arriving for the purpose of employment;

- effective distribution of manpower;

- country socio-economic indexes (development of specific industries of economy);

- the priority right of citizens of the Kyrgyz Republic to occupation of vacant positions in the national labor market.

5. The authorized body in the sphere of foreign affairs of the Kyrgyz Republic draws up Single permission within the established quotas for attraction and use of foreign labor power.

6. In these Provisional regulations the following basic concepts are used:

1) the highly qualified foreign specialist - the foreign citizen or the person without citizenship having the higher education, work experience, professional skills and achievements in specific field of activity;

2) the valid document - the identity document which all parts and details correspond to the samples established by competent authorities of the state which issued it is drawn properly up and fastened by bodies, competent on that, not delayed, belongs to the bearer and has no counterfeits;

3) the foreign individual entrepreneur - the foreign citizen or the stateless person performing individual business activity on the basis of the patent or the certificate granted by body of Tax Service of the Kyrgyz Republic;

4) the foreign specialist - the foreign citizen or the stateless person attracted by the employer and having the corresponding education, necessary qualification for implementation of labor activity;

5) the foreign worker - the highly qualified foreign specialist, the foreign specialist and the foreign individual entrepreneur performing labor activity in the territory of the Kyrgyz Republic;

6) the information system "Single Window" - the automated information system integrated interdepartmental which is subcomponent of the Single system of accounting of external migration and containing modules for registration, maintaining, storage, processing and forming of data on Single permission;
