RESOLUTION OF THE CABINET OF MINISTERS OF THE KYRGYZ REPUBLIC

About approval of the Procedure of public procurements of medicines and medical products through the organizations (representations) founded by the United Nations and also the special purchasing organizations which are working within programs of the United Nations in health sector (including their operational components), signed the agreement (memorandum) with the Cabinet of Ministers of the Kyrgyz Republic

For the purpose of realization of Item 6 of part 3 of article 17 of the Law of the Kyrgyz Republic "About public procurements", according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve the Procedure of public procurements of medicines and medical products through the organizations (representations) founded by the United Nations and also the special purchasing organizations which are working within programs of the United Nations in health sector (including their operational components), signed the agreement (memorandum) with the Cabinet of Ministers of the Kyrgyz Republic according to appendix.

2. Declare invalid the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Procedure of public procurements of medicines and medical products through the organizations (representations) founded by the United Nations" of April 30, 2022 No. 246.

3. To the Ministry of Health of the Kyrgyz Republic:

1) to submit for consideration of the Cabinet of Ministers of the Kyrgyz Republic the draft of the Agreement/memorandum of intention to conduct procurement of medicines and medical products as required through the relevant organizations (representations) founded by the United Nations and also the special purchasing organizations working within programs of the United Nations in health sector (including their operational components);

2) to develop and approve the minimum requirements ensuring safety, quality and efficiency to the medicines and medical products which are purchased through the organizations (representations) founded by the United Nations, and also the special purchasing organizations working within programs of the United Nations in health sector (including their operational components), which signed the agreement (memorandum) with the Cabinet of Ministers of the Kyrgyz Republic;

3) to constitute and approve the list of medicines and medical products taking into account quality, safety and the efficiency which are subject to purchase through the organizations (representations) founded by the United Nations and also the special purchasing organizations which are working within programs of the United Nations in health sector (including their operational components), signed the agreement (memorandum) with the Cabinet of Ministers of the Kyrgyz Republic.

4. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

5. This resolution becomes effective after seven days from the date of official publication.

Procedure of public procurements of medicines and medical products through the organizations (representations) founded by the United Nations and also the special purchasing organizations which are working within programs of the United Nations in health sector (including their operational components), signed the agreement (memorandum) with the Cabinet of Ministers of the Kyrgyz Republic

Chapter 1. General provisions

1. The procedure of public procurements of medicines and medical products through the organizations (representations) founded by the United Nations and also the special purchasing organizations which are working within programs of the United Nations in health sector (including their operational components), signed the agreement (memorandum) with the Cabinet of Ministers of the Kyrgyz Republic (further - the Procedure) regulates implementation of public procurements of medicines and medical products through the organizations (representations) founded by the United Nations and also the special purchasing organizations which are working within programs of the United Nations in health sector (including their operational components), signed the agreement (memorandum) with the Cabinet of Ministers of the Kyrgyz Republic.

2. Authorized state body in health sector of the Kyrgyz Republic and the buying organization in the activities are guided by the Law of the Kyrgyz Republic "About public procurements" (further - the Law), this Procedure, agreements/memorandums signed with the organizations (representations) founded by the United Nations, and also the special purchasing organizations working within programs of the United Nations in health sector (including their operational components), (further - the organizations founded by the UN), and other regulatory legal acts of the Kyrgyz Republic regulating activities in the field of health care and public procurements.

3. The organizations founded by the UN conclude the Agreement/memorandum of intention to conduct procurement of medicines and medical products with the Cabinet of Ministers of the Kyrgyz Republic. At the same time the contract of public procurements with the organizations founded by the UN for specific delivery consists the relevant buying organization based on official request of authorized state body in health sector of the Kyrgyz Republic or the buying organization about supply of high-quality, safe and effective medicines and/or medical products.

4. The procedure of purchases of medicines and medical products through the organizations founded by the UN is made according to requirements of the legislation of the Kyrgyz Republic in the sphere of public procurements, the agreements/memorandums concluded with the organizations founded by the UN, this Procedure.

5. In this Procedure the following basic concepts and determinations are used:

1) buffer stock - the minimum inventory of medicines and medical products created by the organizations of health care necessary for their normal functioning on case of cyclic, seasonal fluctuation of demand;

2) the buying organization - the organization of health care determined by authorized state body in health sector of the Kyrgyz Republic responsible for implementation of public procurements through the organizations founded by the UN;

3) the request for quotation about delivery - the document package of the buying organization containing data, the stipulated in Item 12 presents About, and sent to the organizations founded by the UN and suppliers of medicines and medical products;
