About marking of separate types of the grocery and other food products packed into consumer packaging, means of identification and about the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning separate types of the grocery and other food products packed into consumer packaging

The government of the Russian Federation decides:

1. Approve enclosed:

Rules of marking of separate types of the grocery and other food products packed into consumer packaging, means of identification (further - Rules of marking of grocery products);

Rules of marking of the meat products (sausages and similar food products from meat, offal or blood of animals, from meat and offal of bird) packed into consumer packaging, means of identification (further - Rules of marking of meat products).

2. Determine that participants of turnover of separate types of grocery and other food products, except for meat products (sausages and similar food products from meat, offal or blood of animals, from meat and offal of bird), packed into consumer packaging, determined in the subitem "an" of Item 3 of this resolution (further - grocery products), according to Rules of marking of grocery products and participants of turnover of the meat products (sausages and similar food products from meat, offal or blood of animals, from meat and offal of bird) packed into consumer packaging, determined in the subitem "an" of Item 3 of this resolution (further - meat products), according to Rules of marking of meat products:

a) give to the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - information system of monitoring), the statement for registration in information system of monitoring since March 1, 2025 (except for the participants of turnover of grocery products specified in the subitem "in (1)" Item 3 of this resolution which submit to information system of monitoring the application for their registration in information system of monitoring since September 1, 2025, the participants of turnover of grocery products specified in the subitem "in (2)" Item 3 of this resolution, and the participants of turnover of meat products specified in subitems "in (3)" and "in (4)" Item 3 of this resolution which submit to information system of monitoring the application for their registration in information system of monitoring since March 1, 2026), but no later than 7 calendar days from the date of emergence of need of implementation by the participant of turnover of grocery products (meat products) of the activities connected with input in turnover and (or) turnover, and (or) conclusion from turnover of grocery products (meat products) concerning which the input prohibition in turnover, and (or) turnover, and (or) conclusion from turnover of grocery products (meat products) not marked by means of identification (except for the participants of turnover of grocery products (meat products) falling under action of provisions of Items 3 and 7 of article 2 of the Federal law "About Use of the Control and Cash Equipment when Implementing Calculations in the Russian Federation" is established. At the same time the specified participants of turnover of grocery products (meat products) in the remote or hardly accessible areas perform registration in information system of monitoring within 30 calendar days from the date of emergence of need of implementation of the activities connected with input in turnover by them and (or) turnover, and (or) conclusion from turnover of grocery products (meat products);

b) provide no later than 15 calendar days from the date of registration in information system of monitoring readiness of own software and hardware for information exchange with information system of monitoring and send to the operator of information system of monitoring the request for passing of testing of information exchange electronically;

c) for work on ensuring readiness of own software and hardware for information exchange with information system of monitoring and for passing of testing of information exchange electronically after registration in information system of monitoring send to the operator of information system of monitoring electronically the request for provision of remote access to the issue registration device placed in infrastructure of information system of monitoring;

d) pass test of information exchange of own software and hardware and information system of monitoring according to the procedure posted on the official site of the operator of information system of monitoring on the Internet concerning the transactions connected with marking of grocery products, its input in turnover, turnover and conclusion from turnover according to Rules of marking of grocery products (the transactions connected with marking of meat products, its input in turnover, turnover and conclusion from turnover according to Rules of marking of meat products) no later than 15 calendar days from the date of readiness of own software and hardware for information exchange with information system of monitoring and the direction of the request according to the subitem "b" of this Item.

3. Determine that:

in (4)) participants of turnover of meat products, being peasant farms, agricultural production cooperatives, performing input in turnover of the meat products determined by the subitem "in (3)" this Item, funds of identification for meat products put and represent to information system of monitoring of the data on drawing means of identification and input in turnover of meat products according to Rules of marking of meat products since October 1, 2026;

d) the participants of turnover of grocery products (except for specified in paragraphs second and third this subitem) performing conclusion from turnover of grocery products (as in case of conclusion from turnover when implementing calculations using the control and cash equipment, and different ways) and (or) turnover of grocery products, represent to information system of monitoring of the data on conclusion from turnover and (or) turnover of grocery products according to Rules of marking of grocery products since September 1, 2026;

the participants of turnover of grocery products performing turnover and (or) conclusion from turnover of grocery products concerning the grocery products determined by the subitem "in (1)" this Item, represent to information system of monitoring of the data on conclusion from turnover and (or) about turnover of such grocery products according to Rules of marking of grocery products since June 1, 2027;

the participants of turnover of grocery products performing turnover and (or) conclusion from turnover of grocery products concerning the grocery products determined by the subitem "in (2)" this Item, represent to information system of monitoring of the data on conclusion from turnover and (or) about turnover of such grocery products according to Rules of marking of grocery products since November 1, 2027;

(1)) the participants of turnover of meat products performing turnover and (or) conclusion from turnover of meat products concerning the meat products determined by the subitem "in (3)" this Item, represent to information system of monitoring of the data on conclusion from turnover and (or) about turnover of such meat products according to Rules of marking of meat products since June 1, 2027;

e) the participants of turnover of grocery products (meat products) falling under action of provisions of Items 3 and 7 of article 2 of the Federal law "About Use of the Control and Cash Equipment when Implementing Calculations in the Russian Federation" having the right to represent the data specified in the Section VIII of Rules of marking of grocery products (the Section VIII of Rules of marking of meat products) within 30 calendar days:

from the date of shipment (transfer or acceptance) grocery products (meat products) by transfer (acceptance) of grocery products (meat products) within the transactions providing transition of the property right to grocery products (meat products) and also within commission agreements, and (or) agency agreements, and (or) works agreements, and (or) agreements of the order;

from the date of conclusion of grocery products (meat products) from turnover in case of conclusion of grocery products (meat products) from turnover;

from the date of return of grocery products (meat products) to turnover in case of return of grocery products (meat products) with the unimpaired means of identification;

from the date of modification of the data provided by Sections III, IV and VIII of Rules of marking of grocery products (Sections III, IV and VIII of Rules of marking of meat products), according to the procedure, provided by the Section IX of Rules of marking of grocery products (the Section IX of Rules of marking of meat products) (if changes were made to such data);

e) participants of turnover of grocery products have the right to put funds of identification for grocery products and to represent to information system of monitoring of the data on drawing means of identification, input in turnover, about turnover and about conclusion from turnover of grocery products according to Rules of marking of grocery products since March 1, 2025, and concerning the grocery products determined by the subitem "in (1)" this Item, since September 1, 2025, concerning the grocery products determined by the subitem "in (2)" this Item, since March 1, 2026;

g) participants of turnover of meat products have the right to put funds of identification for meat products and to represent to information system of monitoring of the data on drawing means of identification, input in turnover, about turnover and about conclusion from turnover of meat products according to Rules of marking of meat products since March 1, 2026.

4. Determine that in the territory of the Russian Federation input in turnover of grocery products (meat products) without drawing funds of identification for it and representation in information system of monitoring of data on marking of grocery products (meat products) is allowed by means of identification before the corresponding dates, the stipulated in Item 3 presents of the resolution from which drawing funds of identification for grocery products (meat products) and representation in information system of monitoring of data on drawing on grocery products (meat products) of means of identification and its input in turnover become obligatory.

Within one month after approach of the corresponding date, the stipulated in Item 3 presents of the resolution with which drawing funds of identification for grocery products (meat products) becomes obligatory release by customs authorities for internal consumption or reimport of unmarked grocery products (meat products), the acquired earlier corresponding date, the stipulated in Item 3 presents of the resolution is allowed.

In the presence as of the corresponding date, the stipulated in Item 3 presents of the resolution with which approach drawing funds of identification for grocery products (meat products) becomes obligatory in the territory of the Russian Federation of the unrealized grocery products (meat products) made or imported on the territory of the Russian Federation before this date realization of such grocery products (meat products) not marked is allowed by means of identification before the termination of expiration date of these grocery products (meat products).

5. Registration in the information system used for the purpose of carrying out experiment according to the order of the Government of the Russian Federation of June 26, 2024 No. 857 "About carrying out in the territory of the Russian Federation experiment on marking by means of identification of separate types of grocery and other food products", legal entities and individual entrepreneurs who as of February 28, 2025 were participants of the specified experiment is equated to registration in information system of monitoring according to the subitem "an" of Item 2 of this resolution.

If the data provided within this Item of experiment provided by paragraph one by participants of turnover of grocery products (meat products) to information system in which information support of carrying out this Item of experiment provided by paragraph one was performed do not meet the requirements of Rules of marking of grocery products, participants of turnover of grocery products (meat products) represent to information system of monitoring missing and (or) urgent data before the corresponding date, the stipulated in Item 3 presents of the resolution with which drawing funds of identification for such grocery products becomes obligatory.

5(1). Registration in the information system used for the purpose of carrying out experiment on marking by means of identification of meat products, including sausages and similar food products from meat, offal or blood of animals, from meat and offal of bird packed into consumer packaging, according to the order of the Government of the Russian Federation of November 17, 2025 No. 1823 "About carrying out in the territory of the Russian Federation experiment on marking by means of identification of meat products, including sausages and similar food products from meat, offal or blood of animals, from meat and offal of bird packed into consumer packaging, and also experiment on marking by means of identification of the semifinished products and the refrigerated food products packed into consumer packaging", legal entities and individual entrepreneurs which as of February 28, 2026 were participants of the specified experiment, it is equated to registration in information system of monitoring according to the subitem "an" of Item 2 of this resolution.

If the data provided within this Item of experiment provided by paragraph one by participants of turnover of meat products to the information system used for the purpose of carrying out this Item of experiment provided by paragraph one do not meet the requirements of Rules of marking of meat products, participants of turnover of meat products represent to information system of monitoring missing and (or) urgent data before the corresponding date, the stipulated in Item 3 presents of the resolution with which drawing funds of identification for such meat products becomes obligatory.

6. Determine that the operator of information system of monitoring provides:

a) provision to participants of turnover of grocery products (meat products) of remote access to the issue registration devices placed in infrastructure of information system of monitoring on the conditions provided by Rules of marking of grocery products (Rules of marking of meat products) no later than 30 calendar days from the date of obtaining from the participants of turnover of grocery products (meat products) registered in information system of monitoring, the request for provision of remote access to the issue registration device electronically;

b) the organization of testing of information exchange of software and hardware of participants of turnover of grocery products (meat products) and information system of monitoring no later than 30 calendar days from the date of obtaining from the participants of turnover of grocery products (meat products) registered in information system of monitoring, the notification of the readiness to information exchange with information system of monitoring.

7. Operation of this resolution does not extend to grocery products (meat products) to which according to Rules of marking of grocery products (Rules of marking of meat products) and international treaties of the Russian Federation requirements to obligatory marking by means of identification do not extend.

8. Determine that with approach of the corresponding dates, the stipulated in Item 3 presents of the resolution from which drawing funds of identification for the corresponding types of grocery products (meat products) becomes obligatory provision to the participant of turnover of grocery products (meat products) of the codes of marking necessary for forming of means of identification, is performed by the operator of information system of monitoring on paid basis according to Rules of marking of grocery products (Rules of marking of meat products).

2. The concepts used in these rules mean the following:

"aggregation" - process of consolidation of goods in consumer packagings in group packaging, either in set, or in shipping package, or group packagings in shipping package or sets in shipping package, or shipping packages in shipping package of higher level of enclosure with preserving information on interrelation of codes of identification of each enclosed commodity unit in consumer packaging with code of identification of the created group packaging and (or) shipping package or with code of identification created set and (or) shipping package, about interrelation of codes of identification of each enclosed group packaging with code of identification of the created shipping package or codes of identification of each enclosed set with code of identification of the created shipping package, and also about interrelation of codes of identification of each enclosed shipping package with code of identification of the created shipping package of higher level of enclosure and drawing appropriate means of identification on group packaging or set or code of identification of shipping package for the purpose of ensuring traceability of movement of goods on goods distribution chain without the need for opening of the created group packaging and (or) shipping package or set and (or) shipping package;

"validation of means of identification" - quality evaluation of transformation of code of marking to means of identification and its drawing regarding compliance of its structure to requirements of these rules;

in case of production of goods in the territory of the Russian Federation (including in cases of contract manufacturing), including cases of production of goods from the foreign raw materials placed under customs procedure of free customs zone or under customs procedure of free warehouse - the direction the participant of turnover of goods in information system of monitoring of the notification on primary paid or voluntary conveyance of goods from the producer to the new owner or the other person for the purpose of their alienation to such person or the subsequent realization (sales, including retail) which makes goods available for distribution and (or) uses, or the direction in information system of monitoring by the producer or third-party producer of the notification on input of goods in turnover with representation in information system of monitoring of data according to Item 73 of these rules;

in case of production of goods out of the territory of the Russian Federation (except for the goods imported from state members of the Eurasian Economic Union) - release by customs authorities of the goods imported (imported) into the Russian Federation according to customs procedures of release for internal consumption or reimport and the direction the participant of turnover of goods in information system of monitoring of the notification on input of goods in turnover according to Item 75 of these rules;

in case of production of goods out of the territory of the Russian Federation concerning the goods imported from state members of the Eurasian Economic Union within cross-border trade on customs area of the Eurasian Economic Union - commodity importation to the Russian Federation the participant of turnover of goods and the direction the participant of turnover of goods in information system of monitoring of the notification on input of goods in turnover with representation in information system of monitoring of data according to Item 80 of these rules;

paid or voluntary conveyance to the new owner of the goods acquired by participants of turnover of goods in accordance with the established procedure in case of realization of property by results of tendering within enforcement proceeding and insolvency proceedings, the biddings of the property seized according to the procedure of administrative or criminal proceedings, and also by results of realization of the property turned in accordance with the legislation of the Russian Federation into property of the Russian Federation, and the direction in information system of monitoring by the participant of turnover of goods of the notification on input of goods in turnover according to Item 94 of these rules;
