About approval of Rules of production and turnover of organic products

1. Approve the enclosed Rules of production and turnover of organic products.

2. And conversions of agricultural products of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation to provide to department of the agrofood markets:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective since December 12, 2024 and is subject to official publication.

Rules of production and turnover of organic products

Chapter 1. General provisions

1. These rules of production and turnover of organic products (further - Rules) are developed according to the subitem 5) of article 6 of the Law of the Republic of Kazakhstan "About production and turnover of organic products" (further - the Law) and determine procedure for production and turnover of organic products.

2. In these rules the following concepts are used:

1) the certificate of conformity - the document certifying compliance of objects of technical regulation to the requirements established by technical regulations and (or) documents on standardization;

2) body for confirmation of conformity - the legal entity accredited in accordance with the established procedure for implementation of activities for confirmation of conformity;

3) the certificate of transaction - the document issued by body for confirmation of conformity (in case of export import), confirmatory that certain series or lot of products is made in conditions of production of organic products.

In these rules other concepts according to the Law and the national standard of the Republic of Kazakhstan in ST of PK 3455 "Production of organic products are used. Terms and determinations".

3. These rules are applied to the following categories of the products made and (or) realized as organic:

1) not processed plants and vegetable products, including seeds;

2) farm animals and not processed live stock products;

3) seaweed and not processed aquaculture products;

4) the processed agricultural products, including aquaculture products, for use as foodstuff;

5) stern;

6) wine;

7) other products which are not included in subitems 1), 2), 3), 4), 5) and 6) in this Item, the requirement of production and which turnover are determined by national standards of the Republic of Kazakhstan in the field of production and turnover of organic products.

4. Products received from wild animals are not organic.

Chapter 2. Procedure for transition to production of organic products

5. Upon transition to production of organic products according to Item 2 of article 10 of the Law the following conditions shall be complied:

1) conclusion of the contract with body for confirmation of conformity for holding procedure of confirmation of conformity of production of organic products;

2) observance during all transition period of requirements, the stipulated in Article 11 Laws;

3) others, conforming to the national PK 3111 ST standard "Products organic. Requirements to production process, conversion, marking and realization" (further - the national RK ST standard 3111).

Duration of transition period to production of organic products is established by the national PK 3111 ST standard.

Chapter 3. Procedure for production of organic products

Paragraph 1. Production of organic products

6. Production of organic products is performed in case of observance of conditions of article 11 of the Law and requirements of national standards of the Republic of Kazakhstan in the field of production and turnover of organic products.

7. Additional requirements of transition to production of organic products, the requirement to collection, procurement and turnover of organic products from wild-growing raw materials, special requirements to production and turnover of national Kazakh organic products, space allowance for content of animals, technical requirements and characteristics of buildings and open areas for animals, requirements to accounting for operators of production of organic products are established by the national standards of the Republic of Kazakhstan approved by authorized body in the field of standardization according to the subitem 7) of article 9 of the Law of the Republic of Kazakhstan "About standardization".

8. Marking, packing, packaging, transportation and storage at production phase of organic products are performed according to Chapters 5, of 6 and 7 these rules.

Paragraph 2. The list of the permitted means applied in case of production of organic products

9. The list of the permitted means applied in case of production of organic products affirms authorized body in the field of production and turnover of organic products according to the subitem 4) of article 6 of the Law (further - the list of the permitted means).

10. The list of the permitted means is classified by the following categories:

the fertilizers and soil-improving substances permitted in organic production;

the remedies of plants permitted in organic production;

the fodder raw materials permitted to use in organic livestock production;

the feed additives and substances used in feeding of animals;

substances for cleaning and the disinfection permitted in organic production;
