Procedure for the organization of works on issue by Federal Service for Veterinary and Phytosanitary Surveillance of phytosanitary certificates and quarantine certificates on quarantine products (quarantine material, quarantine freight)

I. General provisions

1. This Procedure establishes rules of consideration of requests for issue, and also decision makings about issue or refusal in issue and issues of phytosanitary certificates (further - the Social Insurance Fund) on export from the territory of the Russian Federation of quarantine products (quarantine material, quarantine freight) (further - quarantine products) and quarantine certificates (further - KS) on the quarantine products imported on the territory of the Russian Federation, when transporting on the territory of the Russian Federation and on the quarantine products exported from quarantine phytosanitary zone, Federal Service for Veterinary and Phytosanitary Surveillance (further - Rosselkhoznadzor).

2. The Social Insurance Fund is drawn up on each batch of quarantine products which is exported from the territory of the Russian Federation.

3. KS is drawn up on each batch of quarantine products imported on the territory of the Russian Federation when transporting on the territory of the Russian Federation and on each batch of quarantine products exported from quarantine phytosanitary zone.

4. The Social Insurance Fund and KS are drawn up on the forms which are subject to strict accounting and having necessary degrees of protection.

The specified forms are the protected printed material of level "A".

5. Registration and issue of the Social Insurance Fund and KS are performed by Rosselkhoznadzor directly or territorial authority of Rosselkhoznadzor (daleeterritorialny Office of Rosselkhoznadzor) which from region of activities export or delivery of quarantine products is performed.

6. The quarantine products on which the Social Insurance Fund is issued shall cross frontier of the Russian Federation when exporting in state members of the European Union within 14 days from the date of issue of the Social Insurance Fund, when exporting to other countries - within 30 days from the date of issue of the Social Insurance Fund. KS on the domestic and imported import quarantine products is issued for term - 15 days from the date of its issue.

7. In case of the statement by the exporter of quarantine products of the requirement about renewal of the Social Insurance Fund within 30 days from the moment of its issue, the Social Insurance Fund it shall be renewed without carrying out additional researches. The Social Insurance Fund is renewed and issued by Rosselkhoznadzor or territorial administration of Rosselkhoznadzor in which region of activities there are transported quarantine products, within 1 working day from the date of confirmation of the fact of issue of the Social Insurance Fund by Rosselkhoznadzor or territorial administration of Rosselkhoznadzor which issued it.

At the same time the requirements established by Chapters II and III of this Procedure are not applied.

8. Issue of KS is performed according to rules and regulations of providing quarantine of plants. Coordination in case of issue of KS is performed between Rosselkhoznadzor or territorial administration of Rosselkhoznadzor issuing KS, and territorial administration of Rosselkhoznadzor to which region of activities import of quarantine products in cases of the plants provided by rules and regulations of providing quarantine is performed.

Coordination is performed no more than 3 working days in time.

II. Procedure for consideration of requests for issue of the Social Insurance Fund and KS

9. Rosselkhoznadzor or territorial administration of Rosselkhoznadzor considers the requests for issue of the Social Insurance Fund and KS which are drawn up according to the appendices N1 and N2 to this Procedure respectively.

10. In case of decision making about issue of the Social Insurance Fund and KS or about refusal in issue of the Social Insurance Fund and KS by Rosselkhoznadzor or territorial authority of Rosselkhoznadzor which from region of activities export of quarantine products is performed with the specified request the following documents necessary for issue of the Social Insurance Fund and KS are considered:

1) the copies of the following documents certified in accordance with the established procedure: the certificate on entering of record about the applicant into the Unified State Register of Legal Entities or the Unified State Register of Private Entrepreneurs (for legal entities and individual entrepreneurs respectively);

the certificate on statement of the applicant on accounting in tax authority (for legal entities and individual entrepreneurs respectively);

2) the document confirming performing preventive phytosanitary disinfecting of the storage facilities intended for storage of the quarantine products declared to import according to rules and regulations of providing quarantine of plants (to the request for issue of KS);

3) the agreement extract (contract) based on which export of quarantine products from the territory of the Russian Federation, in the part concerning the phytosanitary requirements imposed to quarantine products (is made in case of the conclusion of the specified agreement (contract) and availability in it such requirements) (for receipt of the Social Insurance Fund);

4) the identity certificate of the citizen (passport) or other identity document of the applicant (for citizens)

11. Requests for issue of the Social Insurance Fund and KS are registered Rosselkhoznadzor or territorial administration of Rosselkhoznadzor in day of their receipt.
