Chapter 1. General provisions

Article 1. Subject of regulation of the Law

1. This law determines social assistance, the right to social assistance, main objectives, the principles, management of the sector, the integrated system of social services, communal social programs, types and the main conditions of social assessment of family, types of social services, subjects which present them, their powers and cooperation, the bases for provision, the termination, refusal in social support, the rights and obligations of the applicant and the receiver of the public assistance, the social work, the rights and obligations of social workers, sources of financing of the public assistance, the state supervision, monitoring and other relations connected with provision of the public assistance.

Article 2. Legislation on social assistance

1. The relations connected with provision of the public assistance are regulated by the Constitution of the Republic of Armenia, international treaties of the Republic of Armenia, this law, and also other legal acts.

Article 3. The basic concepts used in the law

1. In this Law the following basic concepts are used:

1) the program of individual or family social intervention (further - the program of intervention) - the program constituted within activities of social work in which the estimated social needs of the person or family, the necessary actions directed to the requirements satisfaction, terms provided for their realization, the data of responsible persons or the main characters expected results or the purposes, and also the schedule of maintenance (monitoring) of continuous communication are provided;

2) the homeless person or the family which is living in temporary shelter or in the objects which are not provided for accommodation, not having living space on the property right or uses and not alienating the living space belonging to them on the property right within three years preceding the moment of filing of application and provision of housing and not having opportunities to independently solve problem of the housing;

3) the network of support network of joint activities of representatives of public administration, local government bodies, the organizations and physical persons directed to development and program implementation of intervention for the purpose of effective attraction and use of resources within conducting social case;

4) the card of support card by means of which the social service within the money allocated according to the legislation is provided to person or family;

5) violence - intentional physical, sexual, psychological or economic abuse, threat of application of physical, sexual or economic abuse concerning other person, and also the neglect which is expressed in ignoring of basic needs of this person, lack of necessary care and care if person had obligation and opportunity to provide or provide them;

6) family - small social group of persons, actually living in the same residence, based on marriage, family or dependent relations which members conduct general economy and lead life, jointly defray expenses, are connected by the relations of mutual assistance or the cross liability. The provisions concerning family in the field of the public assistance (the rights, obligations, responsibility etc.), in cases, stipulated by the legislation, also extend to households;

7) social assessment of family process of comprehensive investigation of problems, the property and non-property resources existing in economic, psychological, educational, medical, employment, legal and other social relationships between family or its certain members, directed to identification, assessment of the situation in family, problems and requirements of family, causes and effect relationships between them or the available, possible and necessary resources for the problem resolution and requirements satisfaction of family or its certain members;

8) difficult vital situation - the objective situation interfering normal activity of the person or family which the person or family cannot independently be overcome or overcome partially and which can be caused:

ampere-second disability, age, loss of physical or mental health, capabilities to self-service, problems with capability to control the behavior, capability to move or to be engaged in capability in labor activity or

. with difficulties in the organization of everyday life because of helplessness or social isolation, addictions or the oppressing mental conditions, or

because of homelessness or lack of certain residence or

. in connection with violence, domestic and domestic violence, human trafficking, exploitation of people or the victim of crime or

h. forced return, movement, petition for provision of shelter or recognition of person, or family by the refugee or

and. upon receipt of probation, stay in places of detention or returns from these places, or

to. upon the fact that he is long-term migrant or

l. in the situation requiring urgent reaction or

m in connection with disappearance or capture, or death (death) of the family member as a result of warlike or emergency state;

9) risk to appear in difficult vital situation - the objective situation caused by influence of social, economic or other factors as a result of which person or family can appear in difficult life situation;

10) the communal social program program aimed at social development of community taking into account territorial features and the existing problems of one or several settlements of community which considers the estimated social requirements of the population and resources of community and also includes package of measures and the consecutive steps directed to satisfaction of these requirements corresponds to the five-year development program of community, does not contradict the program of the government;

11) the network of cooperation network of joint activities of state bodies and heads of communities, the organizations and physical persons directed to increase in efficiency and targeting of programs of the public assistance, provision of social services, their expansions and assistance to implementation of new;

12) main requirements sets of the minimum conditions necessary for normal activity of the person or family (food, clothes, footwear, sanitary products, residence, medical care and servicing, secondary education, housing and communal services);

13) the situation requiring urgent reaction as a result of dangerous natural, climatic, technological, biological (epidemic, epidemic of animals, infectious diseases of plants) of the phenomena, applications of types of weapon in certain territory or object, invasions of Armed forces of other state on the territory of the Republic of Armenia, occupation of any territory of the Republic of Armenia as a result of such invasion, availability of direct threat of invasion of Armed forces of other state on the territory of the Republic of Armenia, bombing of the territory of the Republic of Armenia by armed forces of other state, the urgent situation caused by attack of armed forces of other state on armed forces of the Republic of Armenia or other troops or threat of life or to health of the person and also other similar circumstances caused by attack of armed forces of other state on armed forces of the Republic of Armenia or other troops and also other similar circumstances;

14) person or family which are not taking certain residence under the circumstances which are not depending on its will which have no opportunity independently to solve problem of the housing, irrespective of premises availability on the property right;

15) the certificate - the personalized financial record with certain details and form for provision of free government or municipal financial aid which is the basis for acquisition by person who received the certificate, certain property in cases, stipulated by the legislation;

16) social work - the professional activity which is carried out with the purpose of satisfaction of social needs of the person, family or community on the basis of social justice, human rights protection, respect for the personality and other principles established by this law and also developments of capability of the person or family independently to overcome problems, directed to prevention, overcoming difficult life situation, ensuring self-sufficient activity, social development, etc., assistance to social changes or social unity in the cases and procedure established by the legislation;

17) the superviziya of social work is joint process during which the supervisor of social work, using administrative, educational and supplementary methods, promotes the professional growth of the social worker and increase in efficiency and quality of the social services provided to them;

18) socially unsecured family family in which by results of assessment of the income of each member, family composition and other conditions of family in the procedure established by the legislation it is recognized as socially unsecured;

19) social assistance - one or several social services provided to the person or family which appeared in difficult life situation or being in risk group for the purpose of prevention or overcoming difficult life situation by development of capability to self-help, self-determination and the independent solution of the arising problems based on the estimated social requirements or vulnerability;

20) the program of the social help description of one or several measures of policy directed to overcoming difficult life situation or prevention of its deterioration or prevention of hit in such situation according to the purposes and the principles of this Law;

21) Fund of social housing set of the housing stocks created within the programs performed at the expense of the state, municipal budgets or other means which are not forbidden by the law, aimed at provision of housing for person or the family which appeared in difficult life situation;

22) maintaining social case process of social work with the person or family with various social requirements, coordination, and the monitoring of the social worker based on assessment of social requirements and assuming on rendering social support to the person or family according to the plan of intervention, creation of effective cooperation between members of network of support;
