According to article 15-1 of the Law of the Republic of Kazakhstan "About energy saving and increase in energy efficiency" PRIKAZYVAYU:

1. Approve the enclosed Rules of carrying out the post-project analysis on compliance to requirements of class of energy efficiency of buildings, structures and constructions.

2. To provide to committee of the industry of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective since January 1, 2026 and is subject to official publication.

Rules of carrying out the post-project analysis on compliance to requirements of class of energy efficiency of buildings, structures and constructions

Chapter 1. General provisions

1. These rules of carrying out the post-project analysis on compliance to requirements of class of energy efficiency of buildings, structures and constructions (further - Rules) are developed according to Item 1 of article 15-1 of the Law of the Republic of Kazakhstan "About energy saving and increase in energy efficiency" (further - the Law) and determine procedure for carrying out the post-project analysis on compliance to requirements of class of energy efficiency of buildings, structures and constructions.

2. In these rules the following basic concepts are used:

1) class of energy efficiency of the building, structure, construction (further - energy efficiency class) - the level of profitability of energy consumption of the building, structure, construction characterizing its energy efficiency at operation stage;

2) National institute of development in the field of energy saving and increase in energy efficiency (further - National institute) - the legal entity, fifty and more percent of voting shares (shares in the authorized capital) which belong to the state.

3. Subject of the post-project analysis is the new building, structure and construction or the existing building, structure, the construction which underwent changes (expansion, upgrade, modernization, reconstruction, capital repairs) which project consumption of energy resources exceeds equivalent indicator in five hundred tons and above conditional fuel in year.

4. These rules do not extend to the following buildings, structures, constructions:

1) buildings, structures, constructions which are carried to objects of historical and cultural heritage;

2) temporary structures of economic appointment, utility rooms which service life constitutes no more than two years;

3) individual apartment houses, and also the structures which are on seasonal and garden dachas;

4) separate buildings, structures, constructions with a total area less than fifty square meters;

5) cult buildings, structures and constructions;

6) the separate not heated buildings, structures and constructions.

5. The post-project analysis on compliance to requirements of class of energy efficiency of buildings, structures and constructions (further - the post-project analysis) is performed by National institute, within eighteen months after commissioning of the respective building, structure and construction.

If the building, structure and construction put into operation step by step acts as subject of the post-project analysis the post-project analysis on each start-up complex or queue is performed separately.

Chapter 2. Procedure and terms of carrying out the post-project analysis

6. The post-project analysis is performed by means of information system in the field of energy saving and increase in energy efficiency by the analysis and comparison of the data obtained through integration with the information system of the single State Immovable Property Cadastre, information system of the state town-planning inventory, information systems of state bodies automated by systems of accounting of consumption of energy resources.

7. The post-project analysis is carried out on compliance of the class of energy efficiency specified in the acceptance act of object in operation and/or the cadastral passport of real estate object according to information system of the single State Immovable Property Cadastre and/or information system of the state town-planning inventory, the actual class of energy efficiency.

8. The actual class of energy efficiency of the building, structure and construction is determined by information system in the field of energy saving and increase in energy efficiency by the following formula:

  - the actual specific characteristic of expense of heat energy on heating and/or ventilation of the building for the heating period according to the automated systems of accounting of consumption of energy resources, Watt / (square metr*gradus Celsius);

  - the normalized specific characteristic of expense of heat energy on heating and/or ventilation of the building, structure and construction for the heating period, Watt / (square metr*gradus Celsius).
