S. judges., Vorobey G. A., Kenik K. I., Podgrusha V. V., Sarkisovoy E.A., Tikovenko A. G., Filipchik R. I., Shabaylova V. I., G.B. Cone, Shuklina V. Z., having considered question of condition of the constitutional legality in the Republic of Belarus, being guided by article 44 of the Law "About the Constitutional Court of the Republic of Belarus" and article 80 of Regulations of the Constitutional Court,

solved:

1. Accept the Message of the Constitutional Court of the Republic of Belarus to the President and chambers of Parliament of the Republic of Belarus "About condition of the constitutional legality in the Republic of Belarus in 1998" (the text is attached).

2. Publish the Message "About condition of the constitutional legality in the Republic of Belarus in 1998" in the Zvyazda and National Newspaper newspapers, and also in "Vedamastsyakh Natsyyanalnaga to descent of Respubliki Belarus" and "Vesniku Kanstytutsyynaga Suda Respubliki Belarus" in ten-day time from the date of acceptance.

The message of the Constitutional Court of the Republic of Belarus "About condition of the constitutional legality in the Republic of Belarus in 1998"

The constitution proclaims the Republic of Belarus the unitary, democratic, social and constitutional state. The most important task of the constitutional state is providing and protection of rights and freedoms of man and citizen. According to article 2 of the Constitution of people, its rights, freedoms and guarantees of their realization are the supreme value and the purpose of society and state. The solution of this task requires efforts of all state bodies, official and other persons to which implementation of the state functions is entrusted and which bear responsibility for the actions violating the rights and personal freedoms.

The part three of article 21 of the Constitution determined that the state guarantees the rights and freedoms of citizens of Belarus enshrined in the Constitution, the laws and provided by the international obligations of the state. Being component of state mechanism of realization of these guarantees, the Constitutional Court within the competence took all measures available to it necessary for providing rights and freedoms of man and citizen, strengthenings of the constitutional legality. Its activities in this direction in 1998 had the special importance in connection with the 50 anniversary of the Universal Declaration of Human Rights.

Section I.

In 1998 the Constitutional Court of the Republic of Belarus takes out 11 conclusions. (In 1996 the Constitutional Court took out 12 conclusions, from them 6 - on the proceedings initiated on own initiative).
