About purpose of customs posts for representation and registration of goods on customs area

According to Art. 145 of the h. (1), Art. 333 of h (2) the Customs code No. 95/2021 (The official monitor of the Republic of Moldova, 2021, No. 219-225, the Art. 238), with subsequent changes, Item 642 and Item 643 of the Regulations on enforcement of the Customs code No. 95/2021, approved by the Order of the Government No. 92/2023 (The official monitor of the Republic of Moldova, 2023, No. 93-96, 193), with subsequent changes, I ORDER to the Art.:

1. The goods imported on customs area of the Republic of Moldova shall be shown to customs clearance on the customs post responsible for the region of activities where there is receiver of goods.

2. According to the procedure of departure from Item 1 taking into account specifics of goods and method of their transportation goods are represented to customs for customs clearance according to customs procedure of release for free circulation (import) as follows:

1) oil products - on customs posts at the check points through frontier established in appendix No. 2 to the Order of the Government No. 476/2002 about approval of the Regulations on procedure for transportation of the imported oil products;

2) declaring of natural gas - on customs post of "Centru Tranzit Gaz" (MD 231000);

3) the goods transported by railway transport - on railway customs posts;

4) the goods transported sea and inland water transport, the oversized goods transported by pile and also in big-bega, sacks - on customs posts of inland water transport;

5) on any internal or boundary customs post on condition of observance of measures of commercial policy:

a) blood - tariff heading 3002, lymph and human organs;

b) semen - tariff heading 0511;

c) excise stamps - tariff heading 4907;

d) products from gold and silver - tariff heading 7113;

e) medicines, reagents and vaccines with regulated temperature (including joint products as their part);

f) isotopes and radio pharmaceutical radio medicines - tariff heading 2844;

g) isotopes with short time of disintegration;

h) weapon and ammunition;

i) goods for projects implementation of the technical and investment assistance;

j) live birds and animals;

k) bird's eggs;

l) Crustacea, mollusks and other live water invertebrates;

m) the vehicles assessed by excise;

n) tobacco and tobacco products;

o) newspapers and dailies;

p) oil bitumen, in case of boundary registration only bituminous mixes on the basis of natural asphalt or on the basis of natural bitumen, oil bitumen, mineral tar or mineral pitch (in liquid form) - tariff heading 2713, 2714, 2715;

q) oversized goods;

r) the dangerous goods falling under operation of the European agreement on the international road delivery of dangerous goods (DOPOG) signed in Geneva on September 30, 1957;

s) the goods transported by pile;

t) the humanitarian assistance intended for the Central state bodies;

u) the goods and services intended for bodies of system of national defense, safety and public order;

v) goods and services for National Bank of the Republic of Moldova;

6) the goods transported by one transport unit with several consignees (combined loads) can be drawn up on any internal customs post.

7) economic operators from east regions of the Republic of Moldova on customs posts:

o MD215000-KEUShEN 1 (VTP);

o MD217000-BULBOAKA (VTP);

o MD218000-of BENDER 2, (VTP, railway);

o MD219000-RUBBER (VTP);

o MD220000-RYBNITsA (VTP);

o MD224100-ZCV KRIULEN (Kriulen 14, 18) (VKTP);

o MD232000-KUChURGAN (PTPM, car).

8) according to the procedure of departure from subitem 7 economic operators from east regions of the Republic of Moldova shall represent and obtain customs clearance of certain types of goods as follows:

a) alcohol (tariff headings 2207-2208), tobacco and tobacco products (tariff headings 2401-2403), drugs (tariff headings 3003-3004) - MD215000 - KEUShEN 1 (PVI) or MD217000 - BULBOAKA (PVI);

b) oil products (Chapter 27) - MD217000 - BULBOAKA (PVI), MD219000 - RUBBER (PVI) or MD220000 - RYBNITsA (PVI);

c) cast iron, iron, steel (tariff headings 7201, 7202, 7204) - MD219000 - RUBBER (PVI) or MD220000 - RYBNITsA (PVI).

2-1. The goods which are subject to export from customs area of the Republic of Moldova are represented for customs clearance according to Items 298-299 of appendix No. 1 to the Order of the Government No. 92/2023 on implementation of the Customs code No. 95/2021.

2-2. In departure from Section 2-1 with accounting of specifics of goods, their cost and method of transportation goods are shown to customs authority for registration in customs regime of export in the following procedure:

1) declaring of natural gas - on customs post of the Center of transit of gas (MD 231000);

2) the goods moved with railway transport - on railway customs posts;

3) the goods moved with sea and river transport - on customs posts river;

4) the Goods moved through internal customs posts of control by economic operators from east regions of the Republic of Moldova on customs posts:

o MD215000-KAUShENI 1 (VTP);

o MD217000-BULBOAKA (VTP);

o MD218000-BENDER2 (VTP, railway);

o MD219000-rubber (VTP);

o MD220000-RYBNITsA(VTP);

o MD224100-ZTK KRIULENI (Kriulena 14, 18) (VKTP);

o MD232000-KUChURGAN (PTPM, car).

3. Customs posts pay first-priority attention to customs clearance of the perishable and easily changing goods (acceptance and verification of customs declarations).

4. Registration of goods on other internal customs posts of the customs which is not place of registration of legal address of the economic operator and not being the customs specified in Item 2, is allowed in case of idea of the announcement by the economic operator of registration of goods on other customs posts (further - the Agreement) issued by customs in which region of activities the economic operator applicant has legal address. The standard application form and agreements, and also procedure for their registration are established by the instruction given in appendix No. 2 to this order.

5. The customs clearance of goods on other internal customs posts within the same customs where the place of registration of legal address of the economic operator is located, is made without presentation of the agreement on customs clearance.

6. Are cancelled:

1) the Order of the CEO of Customs Service No. 436-O/2017 on establishment of places for customs clearance of goods (The official monitor of the Republic of Moldova, 2017, No. 399-410, the Art. 2017);
