According to articles 5 and 24.5 of the Federal law "About Production Wastes and Consumption" Government of the Russian Federation decides:

1. Approve the enclosed Rules of confirmation of the fact of export, including the third parties, from the Russian Federation of goods, packagings which waste from use is subject to utilization.

2. This resolution becomes effective since January 1, 2025 and is effective till January 1, 2031.

Rules of confirmation of the fact of export, including the third parties, from the Russian Federation of goods, packagings which waste from use is subject to utilization

1. These rules establish procedure for confirmation by the legal entities and individual entrepreneurs performing production of goods, packagings in the territory of the Russian Federation and (or) performing commodity importation including goods in packaging, from the states which are not members of the Eurasian Economic Union or commodity importation from state members of the Eurasian Economic Union (further respectively - producers of goods, importers of goods), the export fact, including the third parties, from the Russian Federation of goods, including goods in packaging, packagings which waste from use is subject to utilization.

2. Confirmation of goods by producers, importers of goods of the fact of export from the Russian Federation of goods, including goods in packaging, packagings which waste from use is subject to utilization is performed for the purpose of confirmation of lack of obligation on ensuring waste recycling from use of goods in respect of the exported goods according to Item 8 of article 24.2 of the Federal law "About Production Wastes and Consumption".

3. These rules are applied to goods, the packagings included in the list, stipulated in Item the 5th article 24.2 of the Federal law "About Production Wastes and Consumption" and also to goods in packaging if the exported goods are not included in the list, stipulated in Item the 5th article 24.2 of the Federal law "About Production Wastes and Consumption", and packaging of such goods is included in the specified list.

4. For confirmation of the fact of export from the Russian Federation of goods, including goods in packaging, packagings which waste from use is subject to utilization in the accounting period the producer of goods, the importer of goods represent to single federal state information system of accounting of waste from use of goods as a part of the reporting on the mass of goods, the packagings made in the territory of the Russian Federation or imported from state members of the Eurasian Economic Union, including about spoiled or about defective goods, about packaging, data on the goods exported from the Russian Federation, packaging, the reporting on the mass of goods, the packagings imported from the states which are not members of the Eurasian Economic Union or as a part of the reporting on accomplishment of independent utilization of goods, packagings which waste from use is subject to utilization:

a) in case of commodity exportation, including goods in packaging, packagings to the states which are not members of the Eurasian Economic Union:

data on customs declarations according to which release of goods in customs procedure of export or re-export is performed and goods were exported from the Russian Federation, in form according to appendix No. 1;

data on the customs declarations C№23 if goods are sent in the international mailings, in form according to appendix No. 2;

b) in case of commodity exportation, including goods in packaging, packagings to the states which are members of the Eurasian Economic Union - data on statistical forms of accounting of movement of goods for the accounting period in form according to appendix No. 3.

5. In case of commodity exportation, including goods in packaging, importers of goods shall provide packagings which waste from use is subject to utilization, the third parties, in addition to the data specified in item 4 of these rules, producers of goods to single federal state information system of accounting of waste from use of goods of the copy of commodity and accompanying documents and other documents (the agreements signed between the producer of goods, the importer of goods and the legal entity or the individual entrepreneur who performed their export from the Russian Federation, delivery-acceptance certificates, acts of the performed works and other documents) confirming the fact of transfer of goods, including goods in packaging, packagings of goods by the producer, importer of goods to the third parties.

6. For confirmation of the fact of export from the Russian Federation of goods, including goods in packaging, packagings which waste from use is subject to utilization outside the accounting period for which ecological collection was paid, the data specified in subitems "an" and (or) "b" of item 4 of these rules are represented as a part of the these rules of the reporting, data specified in paragraph one of item 4 for reduction of the amount of the ecological collection which is subject to payment in the next accounting period in proportion to the mass of the exported goods, packagings according to Item 5 of article 24.5 of the Federal law "About Production Wastes and Consumption".

For confirmation of the fact of export from the Russian Federation of goods, including goods in packaging, packagings which waste from use is subject utilizations concerning which independent utilization outside the accounting period was provided the data specified in subitems "an" and (or) "b" of item 4 of these rules are represented as a part of the these rules of the reporting, data specified in paragraph one of item 4 for reduction of lot of waste from use of goods, the packagings which are subject to utilization in the next accounting period, on the mass of the exported goods, packagings.

7. For the purpose of confirmation of the fact of export from the Russian Federation of goods, packaging the Federal Nature Management Supervision Service requests from the Federal Customs Service confirmation of the data represented by producers of goods, importers of goods according to item 4 of these rules with use of single system of interdepartmental electronic interaction, and in the absence of technical capability of use of such system - with use of interdepartmental electronic document management or departmental system of e-mail.
