1. Approve the enclosed Rules of rendering services of TV and radio broadcasting according to appendix 1 to this order.

2. Recognize invalid some orders according to appendix 2 to this order.

3. To provide to committee of information of the Ministry of Culture and information of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Culture and information of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Legal department of the Ministry of Culture and information of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Culture and Information of the Republic of Kazakhstan.

5. This order becomes effective on the expiration of ten calendar days after day of its first official publication.

Rules of rendering services of TV and radio broadcasting

Chapter 1. General provisions

1. These rules of rendering services of TV and radio broadcasting (further – Rules) articles 7, Item 6 of article 62 of the Law of the Republic of Kazakhstan "About mass media" (further – the Law), the subitem 15) of Item 15 of the Regulations on the Ministry of Culture and information of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 4, 2023 No. 866, are drafted according to the subitem 2) and determine procedure for rendering services of TV and radio broadcasting in the territory of the Republic of Kazakhstan.

2. In these rules the following concepts are used:

1) the subscriber – the physical person or legal entity which signed with the operator of TV and radio broadcasting the agreement on receipt of services of TV and radio broadcasting;

2) subscriber line – the communication line which is part of local network of telecommunications and connecting the subscriber device to means of telecommunications of this network;

3) the distributor of individual satellite and radio intakes (further – the distributor) – the physical person or legal entity distributing maps of conditional access to services of operators of TV and radio broadcasting, the equipment intended for individual acceptance TV, radio signal of the operators of TV and radio broadcasting having the license in the field of TV and radio broadcasting and having own satellite systems of broadcasting to the territories of the Republic of Kazakhstan;

4) TV, radio channel of open entry – TV, the radio channel extended by means of digital on-air and satellite TV and radio broadcasting for the unrestricted group of people without collection of payment for the viewing right;

5) the Internet – the world system of the joint networks of telecommunications and computing resources for transfer of electronic information resources;

6) obligatory TV, radio channel – TV, the radio channel incoming the corresponding list approved by authorized body obligatory for distribution by means of multichannel broadcasting to the territories of the Republic of Kazakhstan, except for networks of digital on-air TV and radio broadcasting and TV and radio broadcasting in networks of telecommunications;

7) TV, radio program – it is informative complete part TV, radio channel which has the corresponding name, the amount of broadcasting also can be used irrespective of other parts TV, radio channel;

8) broadcasting company – physical person or legal entity, being the owner TV, radio channel, or its branch (representation) which received the certificate on registration TV, radio channel;

10) TV and radio broadcasting service – acceptance, processing, storage, transfer, delivery TV, radio programs to the subscriber;

11) the operator of TV and radio broadcasting – the physical person or legal entity which obtained the license for occupation activities for distribution TV, radio channels;

12) broadcasting schedule – the list, the sequence, the name, time of broadcast TV, radio programs, the displaying main directions of the program concept of broadcasting to the specific period;

13) the card of conditional access – the device containing the identifier of individual satellite and radio intakes, providing access for the subscriber to services of the operator of TV and radio broadcasting.

Chapter 2. Procedure for rendering services of TV and radio broadcasting

Paragraph 1. Procedure for acceptance, processing and storage TV, radio programs

3. The operator of TV and radio broadcasting performs acceptance TV, radio programs from broadcasting companies.

4. Broadcasting company:

1) is provided by the uninterrupted mode of giving approved with the operator of TV and radio broadcasting TV, radio programs;

2) provides giving on technical means of the operator of TV and radio broadcasting TV, the radio programs corresponding to the technical parameters specified in the agreement with the operator of TV and radio broadcasting.
