In compliance with the subitem 5) Item 2 of article 85 of the Entrepreneurial code of the Republic of Kazakhstan, PRIKAZYVAYU:

1. Approve the enclosed Rules of maintaining and use of the register of subjects of entrepreneurship.

2. To provide to department of policy of development of entrepreneurship of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its placement on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining and use of the register of subjects of entrepreneurship

Chapter 1. General provisions

1. These rules of maintaining and use of the register of subjects of entrepreneurship (further - Rules) are developed in compliance with the subitem 5) of Item 2 of article 85 of the Entrepreneurial code of the Republic of Kazakhstan and determine procedure for maintaining and use of the register of subjects of entrepreneurship.

2. In these rules the following basic concepts are used:

1) authorized body in the field of informatization - the central executive body performing management and cross-industry coordination in the field of informatization and "the electronic government";

2) business and identification number (further - BIN) - the unique number created for the legal entity (branch and representation) and the individual entrepreneur performing activities in the form of joint venture;

3) authorized body in the field of state registration of legal entities - the central executive body of the Republic of Kazakhstan performing state registration of legal entities being non-profit organizations, accounting registration of their branches and representations;

4) authorized body on entrepreneurship - the central executive body of the Republic of Kazakhstan performing management and cross-industry coordination in the field of development and support of private entrepreneurship;

5) the register of subjects of entrepreneurship (further - the Register) - the electronic database containing data on categories of subjects of entrepreneurship;

6) National certification center of the Republic of Kazakhstan (further - NUTs) - the certification center providing means of the digital signature and registration certificates to physical persons or legal entities for forming of electronic documents in the state and non-state information systems;

7) the single transport circle of state bodies (further - UTS of GO) - the network of telecommunications entering information and communication infrastructure of "the electronic government" and intended for ensuring interaction local (except for the local networks having Internet access), departmental and corporate networks of telecommunications of state bodies, their subordinated organizations and local government bodies, and also other subjects of informatization;

8) the state electronic register of permissions and notifications - the component of the state information system of permissions and notifications containing data about the issued, renewed, suspended, cancelled, extended, resumed and terminated permissions and their duplicates, and also about the received notifications;

9) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

10) lock of "the electronic government" (further - ShEP) - the information system intended for integration of the state and non-state information systems within "the electronic government";

11) information system "The state database "Legal entities" (further - GBD YUL) - the state database intended for maintaining the national register of business and identification numbers also provides assignment of business and identification number to legal entities, branches and representations in interaction with GBD YUL and departmental systems of Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (further - KGD).

3. Determination of category of subjects of entrepreneurship is performed according to the criteria and their threshold values specified in article 24 of the Entrepreneurial code and the Rules of calculation of annual average number of workers and the annual average income of subjects of entrepreneurship approved by the order of the Minister of national economy of the Republic of Kazakhstan of June 29, 2023 No. 125 (it is registered in the Register of state registration of regulatory legal acts for No. 32985).

4. The entrepreneurships this about subjects are processed by the Register in the automated mode and updated annually till December 15.

Chapter 2. Procedure for maintaining register of subjects of entrepreneurship

5. Forming of the Register is performed by authorized body on entrepreneurship based on information obtained by means of information exchange in the following procedure:

1) KGD represents to authorized body on entrepreneurship the following information about the registered subjects of entrepreneurship:

BIN of the subject of entrepreneurship;

data on the income of the subject of entrepreneurship for the last three years, and also about the number of workers and registration data of the subject of entrepreneurship according to Item 6 of these rules;
