About approval of the Procedure for forming and check of electronic types on permanent residence and electronic types on temporary residence and their electronic copies

According to the Law of Ukraine "About features of provision public (electronic public) services" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for forming and check of electronic types on permanent residence and electronic types on temporary residence and their electronic copies enclosed.

2. Bring in appendices 2 and 3 to the resolution of the Cabinet of Ministers of Ukraine of December 30, 2022 No. 1493 "About carrying out verification of some register data" (The Official Bulletin of Ukraine, 2023, No. 4, the Art. 330) the enclosed changes.

Procedure for forming and check of electronic types on permanent residence and electronic types on temporary residence and their electronic copies

1. This Procedure determines the mechanism of forming of electronic types on permanent residence (further - e-type on permanent residence) and electronic types on temporary residence (further - e-type on temporary residence) and their electronic copies and the procedure of their check.

2. The E-type on permanent residence is reflection of information containing in type on permanent residence, the drawn-up person means of the Unified state demographic register (further - the Register), together with the unique electronic identifier (QR code, barcode, digital code) (further - the unique electronic identifier), and also information on the declared/registered residence (stay) (in the presence), the registration number of accounting card of taxpayers (in the presence) created by means of the Single state web portal of electronic services (further - the Action Portal) in connection therewith rather.

Е - the type on temporary residence is reflection of information containing in type on temporary residence, the drawn-up person means of the Register together with the unique electronic identifier, and also information on the declared/registered residence (stay) (in the presence), the registration number of accounting card of taxpayers (in the presence) created by means of the Action Portal according to this Procedure.

In this procedure terms are used in the value given in the Laws of Ukraine "About electronic identification and electronic confidential services", "About features of provision public (electronic public) services", "About provision public (electronic public) services concerning declaring and registration of the residence in Ukraine", "About the Unified state demographic register and documents confirming citizenship of Ukraine, proving the identity or her special status", "About personal data protection", Regulations on the Single state web portal of electronic services approved by the resolution of the Cabinet of Ministers of Ukraine of December 4, 2019 No. 1137 "Question of the Single state web portal of electronic services and the Register of administrative services" (The Official Bulletin of Ukraine, 2020, No. 3, Art. 13; 2022, No. 69, Art. 4171).

3. The E-type on permanent residence and e-type on temporary residence are created gratuitously by means of the Action Portal at the request of person who in the procedure established by the legislation received type on permanent residence or type on temporary residence.

E-type on permanent residence and e-type on temporary residence are created in the presence in the Register of information specified in type permanent residence and in type on temporary residence.

E-type on permanent residence and e-type on temporary residence are created in case type on permanent residence and type on temporary residence are valid.

4. For forming and use of the e-residence permit or the e-residence permit person needs to install mobile application of the Action Portal (Action) on the electronic device which criteria support use of such appendix (further - the electronic device) connected to the Internet and to undergo electronic identification and authentication of users with use of the mechanism provided for the contactless electronic media implanted into the residence permit or the residence permit according to recommendations of International Civil Aviation Organization (IKAO), and also other means of electronic identification with average or high level of credibility allowing to identify unambiguously the personality.

5. Е - type on permanent residence and e-type on temporary residence are created automatically by means of the Action Portal in the presence of connection of the electronic device to the Internet, on condition of operability of the installed mobile application of the Action Portal (Action) and the available electronic information exchange of the Action and Register Portal and/or information and communication systems, registers and databanks, holders (administrators) of which are public authorities, local government bodies, by use of the information which is available in the Register specified in Items 7 and 8 of this Procedure and transferred to the Action Portal and also from the State register of physical persons - taxpayers of rather registration number of accounting card of the taxpayer.

For forming of e-type on permanent residence and e - type on temporary residence information transferred to the Action Portal according to requirements of the legislation (except the digitized fingerprints of hands of person) from the Register and the State register of physical persons taxpayers is used.

Automatically means of mobile application of the Action Portal (action) the notification on forming of the e-residence permit, e-type goes to the person to permanent residence together with the unique electronic identifier or about impossibility of such forming due to the lack in the Register of necessary information.

6. Created e - the type on permanent residence and e-type on temporary residence together with the unique electronic identifier is displayed by means of mobile application of the Action Portal (Action) in the presence of necessary information in the Register.

The unique electronic identifier is automatically created by means of the Action Portal in the presence of connection of the electronic device to the Internet and operability of mobile application of the Action Portal (Action). The generated unique electronic identifier is valid within three minutes from the moment of forming.

Е - the residence permit and the e-residence permit are valid only in the presence of the unique electronic identifier and cannot be used without it.
