About approval of the Regulations on procedure of payments of the amount of payment for issue of the town-planning certificate on designing, the information town-planning certificate, construction permit or on demolition

Based on part (2) Article 111 and part (2) article 162 of the Town-planning and construction code No. 434/2023 (The official monitor of the Republic of Moldova, 2024, Art. No. 41-44, 61), with subsequent changes, DECIDES: the Government

1. Approve Regulations on procedure of payments of the amount of payment for issue of the town-planning certificate on designing, the information town-planning certificate, construction permit or on demolition it (is applied).

2. To bodies of local public authority when calculating the amount of payment for issue of the town-planning certificate, construction permit or on demolition to apply the this provision regulations, internal procedures and cost of preparation and issue of allowing documents in the field of construction.

3. This resolution becomes effective on January 30, 2025.

Regulations on procedure of payments of the amount of payment for issue of the town-planning certificate on designing, the information town-planning certificate, construction permit or on demolition

Chapter I General provisions

1. The regulations on procedure of payments of the amount of payment for issue of the town-planning certificate on designing, the information town-planning certificate, construction permit or on demolition (further – the Provision) establish procedure of payments of the amount of the payment levied by bodies of local public authority for issue of the town-planning certificate on designing, the information town-planning certificate, construction permit or permission to demolition, established by the decision of local council based on this provision and are applied to constructions of any kind, category, assignment and type of property, except for the works financed by public means, socially useful works of national value, objects of military or confidential nature and constructions of diplomatic representations of foreign states in the Republic of Moldova, permission to which is issued in special procedure.

2. For issue of the allowing documents specified in Item 1, the receiver brings payment which amount is annually established by the decision of local council according to this Provision.

3. In case of change within year of factors based on which the amount of payment according to Item 11, the amount of payment for issue of allowing documents approved by the decision of local council was calculated it is updated within 60 days after change approach, but not more often than once a year.

4. Information on the amount of payment for issue of allowing documents approved by the decision of local council is published on the official website of relevant organ. In case of lack of the official website information on the approved amount of payment is hung out on bulletin board in relevant organ.

5. According to the decision of local council, for the purpose of decrease in seismic risk, physical persons are exempted from introduction of payment for issue of allowing documents for work on strengthening of the structures used as the main housing. Based on the decision of local council of Association of owners in condominium use release from introduction of payment for issue of allowing documents for carrying out thermal rehabilitation of apartment apartment houses and works on decrease in seismic risk.

6. In case of issue of allowing documents quickly within 10 working days the increased amount of payment is applied; the coefficient of urgency is established by the decision of local council. Issue of allowing documents quickly is not applied in cases when interaction with the subjects which are not subordinated to the issuer is necessary for issue of the conclusions or other documents according to provisions of the Town-planning and construction code No. 434/2023.

7. The local council has the right to establish privileges or the preferential tariffs for separate categories of investors / receivers in the limits approved by local council.

8. For the objects located on the parcels of land relating to several administrative and territorial units in the cases provided in part (2) Article 108 and part (2) article 156 of the Town-planning and construction code No. 434/2023, the amount of payment for preparation and issue of allowing documents affirms the decision of body of local public authority of the second level based on the conclusions issued by executive body of local public authority of the first level in the territory of which the provided activities will be performed. When calculating the amount of payment for issue of allowing documents the costs necessary for issue of permissions determined according to Chapter II provisions are considered.

9. For issue of the documents specified in Item 6 and subitem 22.5 of the Regulations on procedure for issue of the town-planning certificate for designing and construction permit / demolition for socially useful works of the national value approved by the Order of the Government No. 489/2024, payment it is not levied.

Chapter II the Procedure of payments of the amount of payment for issue of the town-planning certificate, construction permits and on demolition

10. The amount of payment established by local councils for issue of allowing documents on construction (the town-planning certificate on designing, construction permits and on demolition), consists of cost amount, suffered by their preparation and issue, and is calculated according to this Provision as follows:

10.1. depending on organizational structure and the staff list internal procedures on preparation and issue of each type of the allowing document in the field of construction are developed and affirm;

10.2. based on internal procedures of issue of allowing documents the function chart by each type of the allowing document with indication of the average time necessary for each stage, separately on each job grade of compensation of the attracted personnel, with indication of standard times is constituted;

10.3. depending on job grade of the attracted personnel and standard times coordinating dimension of payment for preparation and issue of each allowing document is established;

10.4. calculation of costs for determination of the amount of payment for issue of allowing documents is made on the basis of calculation unit man-hour on formula:

people/hour = (Cpers + Cadit) / Dmedie,

where:

Cpers the amount of all expenses on compensation (the salary fund, medical insurance, social security etc.), but no more than the size of the average salary on the economy predicted by the Government;
