About approval of Regulations about outsourcing of the positions and types of activity connected with insurance or reinsurance activity by insurance or reinsurance companies
Based on part (3), parts (8) Art. 43 and parts (8) Art. 115 of the Law on insurance or reinsurance activity No. 92/2022 (The official monitor of the Republic of Moldova, 2022, No. 129-133, the Art. 229), with subsequent changes, the Executive committee of National Bank of Moldova DECIDES:
1. Approve Regulations about outsourcing of the positions and types of activity connected with insurance or reinsurance activity by insurance or reinsurance companies it (is applied).
2. To the insurance or reinsurance company which transferred to the outsourcing of position and types of activity connected with insurance or reinsurance activity about day of entry into force of this resolution:
2.1. provide compliance of domestic policy and procedures for assessment, management and control to provisions of the regulations specified in Item 1, within 9 months from the date of entry into force of this resolution transferred to outsourcing of positions and types of activity;
2.2. provide compliance of the agreement of the outsourcing signed before entry into force of this resolution, to provisions of the regulations mentioned in Item 1, and provide it to National Bank of Moldova within 9 months from the date of entry into force of this resolution. Provisions of Chapter III of the regulations mentioned in Item 1, are applied respectively to changes in contracts for outsourcing;
2.3. provide in case of outsourcing of ICT according to the procedure of departure from subitem 2.1. and 2.2. this Item observance of provisions of the regulations mentioned in Item 1, within 18 months from the date of entry into force of this resolution.
3. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.
