About approval of the Regulations on declaring and customs control of the goods moved through customs border with the travelers making trips
Based on the item g) h. (9) article 6 of the Law on Customs Service No. 302/2017 (The official monitor of the Republic of Moldova, 2018, Art. No. 68-76, 143), with subsequent changes, item 639 of the Regulations on enforcement of the Customs code approved by the Order of the Government No. 92/2023 (The official monitor of the Republic of Moldova, 2023, 193), with subsequent changes, I ORDER to Art. No. 93-96,:
1. Approve Regulations on declaring and customs control of the goods moved through customs border with the travelers making trips according to appendix.
2. To confer responsibility for accomplishment of this order on customs authorities.
3. To impose control of execution of this order on Department of tax and customs control.
4. This order becomes effective from the date of its publication in the Official monitor of the Republic of Moldova.

to the Order of the director of Customs Service of the Republic of Moldova of September 30, 2024 No. 360-O
1. The regulations on declaring and customs control of the goods moved through customs border with the travelers making trip establish the procedure for declaring and form of customs control applied to the moved goods, the rights and obligations of the travelers making trip in case of declaration of goods.
2. In this Provision the concepts determined in the Customs code No. 95/2021 (further – the Code) and Regulations on the enforcement of the Customs code No. 95/2021, approved by the Order of the Government No. 92/2023 are used (further - the Order of the Government No. 92/2023).
3. The goods moved with travelers through customs border of the Republic of Moldova are subject to customs declaring and customs control. Exceptions of this rule are provided by the Vienna convention on the diplomatic intercourses of April 18, 1961, the Vienna convention on the consular relations of April 24, 1963, other consular conventions or the New York Convention about special missions of December 16, 1969. For the purposes of this provision the goods moved with travelers through customs border are understood as all goods which are in personal baggage of persons making trip as it is stipulated in Article 225 Codes.
4. Customs control of the goods moved with travelers through customs border is carried out by the customs employee responsible for this control, using forms of customs control, stipulated in Clause 343 of this Code.
5. Customs control begins with establishment of the purpose of crossing of goods through customs border of the Republic of Moldova based on the documents specified in Item 14 of this provision, and also explanations of travelers.
6. Customs control of travelers and baggage is performed according to provisions of the Section IX, Chapter III of the Code and subsections 1 and 2 of Section 4 of Chapter IX of the Order of the Government No. 92/2023.
7. Purpose of the goods moved with travelers through customs border is determined in accordance with the terms, stipulated in Clause 358 Codes.
8. When carrying out customs control it is forbidden to do unreasonable harm to person and its property. For carrying out customs control technical means of control which do not create threat of life and to human health can be used, animals and plants and do not damage the goods which are subject to control.
9. During customs control opening and packaging of baggage with goods is performed by travelers at the request of the customs employee.
10. In case of conflict situations when carrying out customs control of the goods moved with travelers through customs border of the Republic of Moldova, the customs employee constitutes the official report addressed to the chief of customs bureau.
11. The goods imported on customs area by travelers can be exposed to repeated customs control and after their release for free circulation according to Art. 350-1 of the item f) the Code.
12. The travelers transporting goods in baggage when crossing customs border shall:
1) to stop in the place of customs control, to enter it and to leave it only with the permission of the official customs employee;
2) to show the transported goods upon the demand of the customs employee;
To provide 3) to the customs employee the supporting documents specified in Item 14, and also the additional data necessary for control and (or) customs clearance of goods;
4) to pay customs debt in the cases provided by the law;
5) to fulfill other legal requirements of the customs employee.
13. Travelers who when crossing customs border have goods in the baggage shall declare them in case of presentation to Customs Service. Goods can be declared:
1) orally;
2) in writing based on the customs declaration of the traveler;
3) action on customs post:
14. In case of declaration of goods in addition to the customs declaration travelers shall submit the following supporting documents taking into account characteristics of goods, delivery and required customs procedure:
1) the actions specified in Item 827 of the Order of the Government No. 92;
2) the document confirming the property right or uses of goods (the contract, the commercial account, or the payment document) - in all cases;
3) the power of attorney issued to person declaring goods in Customs Service on behalf of the physical person having right of possession or uses of goods - is shown in case of representative office of physical person;
4) authorizations, permissions, statements on receipt, export certificates or export receipts - shall be provided for goods to which measures of trade policy or special rules of entrance/departure from the Republic of Moldova extend (for example, animal, movable cultural values, weapon);
5) the expert opinions issued by authorized bodies, confirmatory that the declared goods do not get under the prohibitions established by the current legislation (for example, concerning movable cultural values);
6) the ticket - is shown in case of transportation of goods and the traveler in the same type of public transport of commercial use;
7) permission to stay - is shown by the foreign citizen making trip in case of import or temporary import of goods using the privileges established by the current legislation;
