About approval of the inventory, works, services, rules and amount of the public procurements conducted at subjects of small and medium business

1. Approve:

1) the Inventory, works, services which public procurements are conducted at subjects of small and medium business according to appendix 1 to this order;

2) Rules of implementation of public procurements of goods, works, services at subjects of small and medium business according to appendix 2 to this order;

3) Amount of goods, works, services which public procurements are conducted at subjects of small and medium business according to appendix 3 to this order.

2. To provide to department of the legislation of public procurements and purchases of the quasi-public sector of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. This order becomes effective since January 1, 2025 and is subject to official publication.

Rules of implementation of public procurements of goods, works, services at subjects of small and medium business

1. These rules of implementation of public procurements of goods, works, services at subjects of small and medium business (further – Rules) are developed according to Item 7 of article 27 of the Law of the Republic of Kazakhstan "About public procurements" (further – the Law) and determine procedure of public procurements of goods, works, services at subjects of small and medium business.

2. Rules do not extend to public procurements of goods, works, services:

1) performed according to the inventory, works, services by which the method of implementation of public procurements is determined by authorized body approved by the order of the Minister of Finance of the Republic of Kazakhstan of August 15, 2024 No. 546 (it is registered in the Register of state registration of regulatory legal acts at No. 34933);

On which 2) the decision of the Government of the Republic of Kazakhstan establishes withdrawals from national treatment;

3) persons which are purchased from public associations with disability of the Republic of Kazakhstan and (or) the organizations created by public associations of the persons with disability of the Republic of Kazakhstan making and (or) delivering goods, performing works, rendering services according to the List of separate types of goods, works, services by the certain central executive body performing management and cross-industry coordination in the sphere of social protection of the population in coordination with authorized body in the sphere of public procurements and antimonopoly authority.

3. Public procurements of goods, works, services are performed among subjects of small and medium business by methods, the stipulated in Article 10 Laws and according to the procedure, determined by Rules of implementation of public procurements, in case of accomplishment of two following conditions:

1) goods, works, services are included in the list according to appendix 1 to this order;

2) the cost of the Rules of goods, works, services specified in the subitem 1) of this Item does not exceed the amounts specified in appendix 3 to this order.

4. In case of recognition not taken place public procurements of the goods, works, services performed at subjects of small and medium business in the bases, Items 7 and 10 of article 15 of the Law provided by the subitem 1) of Item 1,, the customer makes the decision on implementation of public procurements among all potential suppliers by methods, the stipulated in Article 10 Laws and according to the procedure, determined by Rules of implementation of public procurements.

5. Rules do not limit participation of subjects of small and medium business in public procurements of other goods, works, services.
