About approval of the Regulations on recognition of accessory of service or transaction to financial/limited payment service and identification of implementation of license-free activities in the market of non-bank financial services and the payment market

According to Articles 7, of 15, 55-1, 56 of the Law of Ukraine "About the National Bank of Ukraine", Articles 4, of 21, 23 Laws of Ukraine "About financial services and finance companies", Articles 8, of 77, 78 Laws of Ukraine "About payment services", for the purpose of settlement of procedure for recognition of accessory of the services or transactions containing signs of one or several types of financial services / limited payment services to financial/limited payment services and identifications of implementation of license-free activities in the market of non-bank financial services and the payment market of Board of the National Bank of Ukraine decide:

1. Approve Regulations on recognition of belonging of service or transaction to financial/limited payment service and identification of implementation of license-free activities in the market of non-bank financial services and the enclosed payment market.

2. To department of methodology of regulation of activities of non-bank financial institutions (Sergey Savchuk) after official publication to inform non-bank suppliers of financial and payment services information on adoption of this resolution.

3. The resolution becomes effective from the date of, its official publication following behind day.

I. General provisions

1. This Provision is developed according to the laws of Ukraine "About the National Bank of Ukraine", "About financial services and finance companies" (further - the Financial services act), "About payment services" (further - the Law on payment services).

2. This Provision determines:

1) the list of sources of information which can be used for the purposes of this provision, both requirements to information and criteria to which there shall correspond information obtained from the following sources;

2) procedures and mechanisms of identification of implementation by objects by supervisions/persons which are potentially performing license-free activities, license-free activities in the market of non-bank financial services and the payment market including procedure of the profound analysis / cameral check;
