Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is support, development of creative economy and regulation of the relations in the field.

Article 2. Legislation on creative economy

The legislation on creative economy consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about creative economy then are applied rules of the international treaty.

Article 3. Basic concepts

In this Law the following basic concepts are used:

the creative industry - set of the types of economic activity connected with creation, production, storage, distribution and promotion of goods (works, services) based on the priority of creativity, mental abilities, and also intellectual property and having economic value;

the park of the creative industry - the organization-legal forming operating on exterritorialities within the territory of the Republic of Uzbekistan for the purpose of creating favorable conditions for development of the sphere of the creative industry;

subjects of the creative industry - the physical persons and legal entities which are engaged in creation, production, storage, distribution and promotion of creative product;

creative economy - the economy industry directed to creation of goods (works, services) with economic value as a result of the human potential based on creativity, mental abilities, and also innovations and technologies;

creative product - the goods (works, services) having economic value, and also other subjects of civil transactions in the field of creative economy.

Article 4. The basic principles in the field of creative economy

The creative economy is based on the following principles:

legality;

openness and transparency;

freedom of creativity;

equality;

legal protection of creative product.

Article 5. Principle of legality

The relations in the field of creative economy shall be performed according to the Constitution of the Republic of Uzbekistan, this Law and other acts of the legislation.

Article 6. Principle of openness and transparency

Information in the field of creative economy shall be open and transparent. Information constituting the state secrets and which disclosure is limited to the law is exception.

State bodies shall create to subjects of the creative industry conditions for obtaining and free use of information by methods, stipulated by the legislation about openness of activities of state governing bodies, and also about guarantees and freedom of information access.

Article 7. Creativity liberty principle

The creative economy is based on freedom of scientific, technical and art creativity.

All persons are free in the choice and implementation of activities in one or several spheres of the creative industry, and also in creation of creative product.

Freedom of creativity shall not go for the actions causing damage of honor, to advantage and goodwill of other persons, inducing or propagandizing illegal actions and shall not contradict public morality.

Article 8. Principle of equality

Subjects of the creative industry are equal in implementation of the activities, including use of the measures of support and infrastructure provided by the state.

Article 9. Principle of legal protection of creative product

Creative products are result of intellectual and creative activities and are protected according to the legislation.

Article 10. Spheres of the creative industry

For the purposes of this Law of the sphere of the creative industry include:

literary creativity;

applied art and workmanship;

architecture, designing and urbanistics;

audiovisual art;

performing art;

organization of concert and spectacular activities and cultural events;

fashion and art of design;

activities of the museums, art galleries (exhibitions) and information and library activities;

creative activities in publishing house and typography;

creative activities in the sphere of mass media and the creative activities performed by transfer through the world information Internet;

producer activities;

creative activities in the sphere of digital technologies;

creative activities in the sphere of advertizing;

activities for preserving objects of art and objects of cultural heritage;

fine arts.

Chapter 2. State policy in the field of creative economy

Article 11. The main directions of state policy in the field of creative economy

The main directions of state policy in the field of creative economy are:

creation of necessary conditions for manifestation by citizens of the creative and intellectual potential in the sphere of the creative industry;

increase in turnover of creative products by transformation of the creative industry into one of active industries of economy;

creation to subjects of the creative industry of equal opportunities in the state support;

development of small and medium business by means of support of spheres of the creative industry;

support of science and scientific activities in the field of creative economy and assistance in realization of the creative ideas and projects;

creation of necessary infrastructure for subjects of the creative industry;

ensuring use of scientific and technological achievements and innovative approaches during creation of creative products;

enhancement of education system, implementation of modern educational programs in the sphere of the creative industry for the purpose of development of competences of this sphere;

elimination of restrictions on realization of creative potential and opportunities of subjects of the creative industry;

ensuring wide recognition of national culture and national brands on the international scene.

Article 12. Strategies of development of creative economy

Strategies of development of creative economy are developed and implemented on the basis of modern achievements for the purpose of development of human capital, the country, carrying out single state policy in the field of creative economy.

Strategies of development of creative economy can be accepted for the near-term and long-term outlook.

Strategies of development of creative economy determine the purposes and tasks facing the state and society, target indicators for the corresponding period, and also action plans on their realization.
