About procedure for identification of goods of electronic trading concerning which the possibility of their return after acquisition is provided

According to Item 11 of Article 309-6 of the Customs code of the Eurasian Economic Union and Item 169 of appendix No. 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98, Council of the Eurasian economic commission DECIDED:

1. Determine that concerning goods of electronic trading for which the possibility of return after their acquisition on electronic trading platforms is provided their identification in the following procedure is performed:

a) the operator of electronic trading before implementation of the goods delivery of electronic trading provides to the physical person who is their receiver drawing on each commodity unit or its packaging which is inseparable from goods before its use and in which the goods are provided for retail sale, of the identification number provided from 20 characters (digits, letters of the Latin alphabet) and (or) in barcode type, or for the purpose of identification uses the means of identification put according to the Agreement on marking of goods means of identification in the Eurasian Economic Union of February 2, 2018 or identification number according to system of accounting of goods of the operator of electronic trading, or serial (factory) article number;

b) the data allowing to identify goods of electronic trading, specified in the subitem "an" of this Item are entered into information system of the operator of electronic trading, and also if it is stipulated by the legislation state member of the Eurasian Economic Union, in documents according to which such goods are issued to the physical person who is their receiver;

c) identification of the returned goods of electronic trading is performed by reconciliation of the data specified in the subitem "an" of this Item with the data entered into information system of the operator of electronic trading or if it is stipulated by the legislation state member of the Eurasian Economic Union, in documents according to which such goods were issued to the physical person who is their receiver.

2. This Decision becomes effective after 10 calendar days from the date of its official publication, but not earlier than the date of entry into force of the Protocol on introduction of amendments to the Agreement on the Customs code of the Eurasian Economic Union of the April 11, 2017 signed on December 25, 2023.
