Chapter 1. General provisions

Article 1. Scope of the law

1. According to this Law:

1) the general requirements to content, procedure for development, the publication and application of technical regulations on products aimed at providing free movement of products, transparency of processes are established;

2) the relations of the activities performed in regulated spheres of technical regulation, including assessment of conformity are governed;

3) the rights and obligations of the governing bodies participating in process of assessment of conformity of products to the established requirements are determined.

2. Technical regulation is under authority of the state.

3. This law extends on business entities, state bodies and local self-government, and also the relevant organizations.

Article 2. The basic concepts used in the law

1. The basic concepts used in this law are:

1) technical regulations set of the types of activity establishing the main requirements to product or products and the related processes including sales terms, and also rules of entry into the market and assessment procedure of compliance;

2) the technical regulations document accepted according to the international treaties of the Republic of Armenia ratified according to the procedure, established by the legislation of the Republic of Armenia, either the Law of the Republic of Armenia, or the order of the Government of the Republic of Armenia which establishes mandatory requirements to product characteristics and/or processes, the production methods connected with products including the applied administrative provisions, and also conditions of import and sales of products. It can also include the concepts, symbols applicable to product, process or production method, requirements to packaging, marking and marking, sanitary, phytosanitary, veterinary standards, and also requirements to registration of product;

3) the established requirements requirements established by technical regulations, documents on standardization and technical specifications;

4) other requirements - any requirements (except for technical specifications) imposed to product, in particular, directed to consumer protection or the environment, and also influencing further processing of product after its entry into the market such as conditions of use, reuse or utilization if these conditions can significantly influence structure, nature or sale of product;

4. 1) the sanitary, phytosanitary and veterinary and sanitary regulations requirements and procedures for compulsory execution established concerning penetration, strengthening or distribution of harmful organisms, diseases, carriers of diseases or pathogenic organisms, including animals and/or plants concerning products, freights, materials, vehicles, additives, including foodstuff or forages, pollutants, toxins, wreckers, weeds, risks connected with transfer and distribution of pathogenic organisms for the purpose of protection and also requirements and procedures for compulsory execution and application for the purpose of prevention of other damage connected with distribution of harmful organisms;

5) Specifications (specifications) - the conditions containing in the document which determine required product characteristics (including the quality level, characteristics, safety or the sizes, including requirements imposed to product), and also requirements to terminology, testing and test methods, packaging, marking, marking and assessment procedures of compliance. Technical specifications also cover methods and production processes of products.

6) Products - industrial and agricultural output, including products of animal and phytogenesis. Electrical and heat energy, the natural and liquefied gas, water, buildings and constructions in the field of city construction and the related processes are also considered as the products delivered for consumption;

6. 1) identification of product process by means of which product belonging to certain technical regulation (rules) is determined and is established compliance of this product to technical documents on this product;

6. 2) products batch - certain product quantity of the same appointment, the made (made) same producer (the authorized representative of the producer, the distributor, the importer) by the same principle of production, with the same structure and to the established requirements conforming same characterizing safety, accompanied with one commodity accompanying document;
