1. Approve the enclosed standard regulations on regional commission on counteraction to human trafficking.

2. To provide to department on fight against organized crime of the Ministry of Internal Affairs of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) within five working days after state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan the notification of Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan on execution of the action provided by the subitem 1) of this Item.

3. To impose control of execution of this joint order on the internal affairs of the Republic of Kazakhstan and the vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan supervising the deputy minister.

4. This order becomes effective after ten calendar days after day of its first official publication.

Standard regulations on regional commission on counteraction to human trafficking

Chapter 1. General provisions

1. This standard regulations on regional commission on counteraction to human trafficking (further – the Provision) are developed according to Item 5 of article 11 of the Law of the Republic of Kazakhstan "About counteraction to human trafficking".

2. Regional commission on counteraction to human trafficking (further – the Commission) is advisory advisory body under local executive bodies of areas, cities of republican value and the capital (further – MIO).

3. The commission in the activities is guided by the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

Chapter 2. Tasks and functions of the Commission

4. Tasks of the Commission:

1) the analysis of the existing situation in the field of counteraction to human trafficking;

2) development of offers and recommendations on:

to questions of fight against illegal export, import, human trafficking and assistance to the victims of human trafficking;

to informing the population on situation with human trafficking and the dangers of this phenomenon existing in human rights measures and opportunities of the request for the help specified to the sphere;

to enhancement of the legislation of the Republic of Kazakhstan according to the accepted international legal documents in the field of the prevention and suppression of human trafficking, and also protection of the victims of human trafficking and rendering the help to them;

to increase in the overall performance directed to identification and elimination of the reasons and conditions promoting human trafficking and rendering the help to them.

5. Functions of the Commission:

1) sending an inquiry to subjects of counteraction to human trafficking for receipt of the information required;

2) the invitation to meeting and hearing of subjects of counteraction to human trafficking about the work which is carried out by them, and also development of suggestions for improvement of their activities;

3) involvement of independent experts, specialists and scientists;

4) interaction with state bodies, public associations and the organizations, and also mass media in the problem resolution in the field of counteraction to human trafficking and assistance to the victims of human trafficking;

5) development of offers on development of appropriate programs and plans for counteraction to human trafficking.

Chapter 3. Structure, organization and procedure for activities of the Commission

6. The structure of the Commission affirms the order of the akim of area, city of republican value and the capital according to the procedure, established by the Law of the Republic of Kazakhstan "About local public administration and self-government in the Republic of Kazakhstan".

7. The commission consists of the chairman, the vice-chairman, members of the commission and the secretary. The secretary of the Commission is determined from number of persons employed of working body of the Commission and is not her member.

8. The Commissions are included representatives of MIO in the field of social protection and employment of the population, health care, education, culture and information, tourism and sport, domestic policy, territorial authorities of police, prosecutor's office, justice, divisions of the Border service of Committee of homeland security of the Republic of Kazakhstan and non-profit organizations.

9. Commission chairman is the deputy akim of area, city of republican value and the capital.

10. Functions of working body are assigned to the relevant structural division of MIO.

11. Commission session is held by the commission chairman, and in its absence the vice-chairman.

12. Work of the Commission is carried out on the basis of the annual plan.

13. Commission sessions are held as required, but at least once a half-year, and are considered competent if at them there are at least two thirds of total number of members of the commission.

15. Coordination of activities of the Commission is performed by the Interdepartmental commission on counteraction to human trafficking.

Working body of the Commission organizational technical supply carries out works of the Commission, including prepares offers on the agenda of commission session, necessary documents, materials which shall be directed to members of the commission in three working days prior to carrying out commission session with appendix of the draft of the protocol.
