About the Register of subjects of small and medium entrepreneurship

In pursuance of the paragraph of the fifth of article 21 of the Law of the Republic of Belarus of April 22, 2024 "About change of the laws concerning business activity" the Council of Ministers of the Republic of Belarus DECIDES: No. 365-Z

1. Approve Regulations on procedure for forming, maintaining the Register of subjects of small and medium entrepreneurship and provision of data from it it (is applied).

2. Bring in Item 5 of the Regulations on procedure for storage of the data which are tax secret, access to them and their disclosure approved by the resolution of Council of Ministers of the Republic of Belarus of September 16, 2004 No. 1149, the following changes:

to add part one after the paragraph of the fourth with the paragraph of the following content:

"To the Ministry of Labour and Social Protection, the Ministry of Economics, Social Security Fund of the population of the Ministry of Labour and Social Protection, the local executive and administrative organs and their structural divisions performing state powers of authority in the field of economy and finance, to the bodies conducting administrative process for accomplishment of the tasks and functions assigned to them by the legislation (regarding the data containing in the Register of subjects of small and medium entrepreneurship);";

in part two "sixteenth" to replace the word with the word "seventeenth".

3. This resolution becomes effective since October 1, 2024.

Regulations on procedure for forming, maintaining the Register of subjects of small and medium entrepreneurship and provision of data from it

Chapter 1. General provisions

1. This Provision determines procedure for forming, maintaining the Register of subjects of small and medium entrepreneurship (further - the Register), including structure of the data included in it, and provisions to interested persons of the data (their part) containing in the Register.

2. For the purposes of this provision terms and their determinations in the values established in the Law of the Republic of Belarus of July 1, 2010 No. 148-Z "About support of small and medium entrepreneurship" are used.

3. Maintaining the Register is performed on the following principles:

completeness and reliability of the data containing in it;

information exchange with other state information resources and systems of the Republic of Belarus;

automation of forming of the Register.

4. The data containing in the Register are used for:

ensuring the single state systematized accounting of subjects of small and medium entrepreneurship;

adoptions by authorized body (organization) of the decision on rendering the state support to the subject of small or medium business;

project developments of the state program in the field of the state support of small and medium entrepreneurship;

enhancement of procedure and conditions of the state support of subjects of small and medium entrepreneurship.

5. Inclusion of data in the Register, modification of it, provision to interested persons of the specified data are performed on a grant basis.

The data included in the Register which are not tax secret are open and public and are posted on the official site of the Ministry of Taxes and Tax Collection on the global computer Internet.

Chapter 2. Procedure for forming and maintaining register

6. The register is created and kept in information system of the Ministry of Taxes and Tax Collection.

7. Storage of the data containing in the Register including backup copies of databases, data on the changes made to it, is performed according to the legislation on archiving and clerical work.

8. The Ministry of Taxes and Tax Collection, being the owner Reestra, in case of its forming and maintaining:

determines program technical means of maintaining the Register;

determines structure of the reference books used for maintaining the Register;

performs the automated consolidation of the data included in the Register, updating and storage of data of the Register;

includes data in the Register, makes changes to it;

in the procedure established by this Provision provides information from the Register;

provides fulfillment of requirements of the legislation on information, informatization and information security;

appoints the officials responsible for forming and maintaining the Register, provision of data from it, for ensuring safety of data of the Register and their protection against unauthorized access;

performs other functions on forming and maintaining the Register.

Chapter 3. The scope of information, included in the register

9. The Register joins the following data on the commercial organizations and physical persons performing individual business activity, answering the stipulated in Clause 3 Laws of the Republic of Belarus "About support of small and medium entrepreneurship" to criteria of reference to subjects of small and medium entrepreneurship:

9.1. date of inclusion of the commercial organization, the physical person performing individual business activity in the Register;

9.2. complete (reduced in the presence) the name of the commercial organization, surname, own name, middle name (if that is available) the physical person performing individual business activity;

9.3. accounting number of the payer;

9.4. the location of the commercial organization, the residence of the physical person performing individual business activity;

9.5. the average number of employees of the commercial organization, the individual entrepreneur for the corresponding calendar year;

9.6. category of the subject of small and medium entrepreneurship (individual entrepreneur; the physical person performing individual business activity according to subitems 2 and 3 of part one of Item 1 of Article 22 of the Civil code of the Republic of Belarus; the small organization (with average number of workers calendar year prior to 50 people inclusive and from 51 to 100 persons inclusive); average organization);

9.7. core activity of the commercial organization, individual entrepreneur;

9.8. date and the basis of change of the data included in the Register;

9.9. date and the basis of exception of the commercial organization, the physical person performing individual business activity of the Register.
