About approval of regulations on the interdepartmental commission on counteraction to human trafficking

1. Approve enclosed:

1) regulations on the interdepartmental commission on counteraction to human trafficking (further – the Commission);

2) structure of the Commission;

2. To provide to department on fight against organized crime of the Ministry of Internal Affairs of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) within five calendar days from the date of adoption of this order the direction it the copy in electronic form in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) submission to Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the action provided by the subitem 1) of this Item.

3. To impose control of execution of this joint order on the internal affairs of the Republic of Kazakhstan and the vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan supervising the deputy minister.

4. Declare invalid the joint order of the Minister of Internal Affairs of the Republic of Kazakhstan of July 1, 2022 No. 550 and the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of July 1, 2022 No. 235 "About formation of the Interdepartmental commission on questions of fight against illegal export, import and human trafficking".

5. This order becomes effective after day of its first official publication, but not earlier than September 5, 2024.

Regulations on the interdepartmental commission on counteraction to human trafficking

Chapter 1. General provisions

1. The interdepartmental commission on counteraction to human trafficking (further – the Commission) is advisory advisory body under the Ministry of Internal Affairs of the Republic of Kazakhstan and the Ministry of Labour and social protection of the population of the Republic of Kazakhstan.

2. The purpose of activities of the Commission is development of offers and recommendations about questions of counteraction to human trafficking.

3. The commission in the activities is guided by the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

4. Working body of the Commission are Department on fight against organized crime of the Ministry of Internal Affairs of the Republic of Kazakhstan and Department of special social services of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan on rotational basis with frequency in two years.

Chapter 2. Main objectives of the Commission

5. The main objectives of the Commission are:

1) the analysis of the existing situation in the field of counteraction to human trafficking;

2) development of offers and recommendations on:

to questions of fight against illegal export, import, human trafficking and assistance to the victims of human trafficking;

to informing the population on situation with human trafficking and the dangers of this phenomenon existing in human rights measures and opportunities of the request for the help specified to the sphere;

to enhancement of the legislation of the Republic of Kazakhstan according to the accepted international legal documents in the field of the prevention and suppression of human trafficking, and also protection of the victims of human trafficking and rendering the help to them;

to increase in the overall performance directed to identification and elimination of the reasons and conditions promoting human trafficking and rendering the help to them.

Chapter 3. Rights of the Commission

6. The commission for the purpose of realization of the tasks assigned to it has the right according to the procedure, established by the legislation:

To request 1) from subjects of counteraction to human trafficking the materials and information necessary for implementation of the activities;

2) to coordinate activities of regional commissions for counteraction to human trafficking;

3) to hear reports of regional commissions on counteraction to human trafficking and the subjects of counteraction to human trafficking dealing with issues of fight against illegal export, import, human trafficking and assistance to the victims of human trafficking about the work which is carried out by them and to develop suggestions for improvement of their activities;

4) to attract independent experts, specialists and scientists;

5) to interact with state bodies, public associations and the organizations, and also mass media in the problem resolution on fight against human trafficking and assistance to the victims of human trafficking;

6) to develop offers on development of appropriate programs and plans for questions of counteraction to human trafficking.

Chapter 4. Organization and procedure for activities of the Commission

7. Management of the Commission is performed of the Minister of Internal Affairs of the Republic of Kazakhstan and the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan on rotational basis with frequency in two years which are its chairmen.
