About interpretation of part (5) article 3 of the Law on external assessment of judges and prosecutors and modification of some regulations No. 252/2023 according to provisions of parts (5) and (6) article 40 of the Law on Prosecutor's office No. 3/2016
Based on Item c) article 66 of the Constitution of the Republic of Moldova and part (2) article 72 of the Law on regulations No. 100/2017
The Parliament adopts this organic law.
Art. I. – For the purposes of part (5) article 3 of the Law on external assessment of judges and prosecutors and modification of some regulations No. 252/2023 (The official monitor of the Republic of Moldova, 2023, 581), with subsequent changes, the second offer is also used by Art. No. 325-327, if resignation is filed by the prosecutor concerning whom disciplinary production is begun. The decision according to the resignation is passed by the Attorney-General who issues the order on dismissal of the prosecutor with providing the guarantees provided by the Law on Prosecutor's office No. 3/2016.
Dismissal of the prosecutor based on the resignation filed according to the Law on external assessment of judges and prosecutors and modification of some regulations No. 252/2023, does not interfere with disciplinary production and on circumstances to involvement of the prosecutor to disciplinary responsibility according to part (1) article 36 of the Law on Prosecutor's office No. 3/2016.
Art. II. – This law becomes effective from the date of its publication in the Official monitor of the Republic of Moldova
