1. Approve the enclosed Rules of provision in authorized body by the telecom operators and (or) owners of communication networks performing activities in the territory of the Republic of Kazakhstan, aggregative data in case of threat of origin and emergence of the emergency situations of social, natural and technogenic nature caused by natural disasters (earthquakes, mudflows, avalanches, floods and others), crisis ecological situations, the natural fires, epidemics.

2. To provide to committee of telecommunications of the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of digital development, innovations and the aerospace industry.

4. This order becomes effective since January 7, 2025 and is subject to official publication.

Chapter 1. General provisions

1. These rules of provision in authorized body by the telecom operators and (or) owners of communication networks performing activities in the territory of the Republic of Kazakhstan, aggregative data in case of threat of origin and emergence of the emergency situations of social, natural and technogenic nature caused by natural disasters (earthquakes, mudflows, avalanches, floods and others), are developed by crisis ecological situations, the natural fires, epidemics (further – Rules) according to article 15-3 of the Law of the Republic of Kazakhstan "About communication" (further – the Law) and determine procedure for provision in authorized body by the telecom operators and (or) owners of communication networks performing activities in the territory of the Republic of Kazakhstan, aggregative data in case of threat of origin and emergence of the emergency situations of social, natural and technogenic nature caused by natural disasters (earthquakes, mudflows, avalanches, floods and others), crisis ecological situations, natural fires, epidemics.

2. Action of these rules extends to all telecom operators and (or) owners of the communication networks performing activities in the territory of the Republic of Kazakhstan.

3. In these rules the following basic concepts are used:

1) emergency situation of social nature – the emergency situation caused by origin in certain territory of contradictions and the conflicts in the field of the social relations which can entail or the human victims, damnification to health entailed, significant property damage or violations of conditions of life activity of the population;

2) the telecom operator – the physical person or legal entity registered in the territory of the Republic of Kazakhstan, rendering communication services and (or) operating communication networks;

3) aggregation of data – processing and provisions of information in generalized view in case of which there is its depersonalization. Aggregative data are used by the telecom operator for forming of the reporting, implementation of the analysis and researches;

4) the owner of communication network – physical person or legal entity which possesses part of communication network public and (or) the corresponding category of single network of telecommunications;

5) emergency situation – the situation in certain territory which developed as a result of accident, the fire, harmful effects of dangerous production factors, natural hazard, catastrophic crash, natural or other disaster which can entail or was entailed by the human victims, harm to human health or the environment, significant material damage and violation of conditions of life activity of people;

6) authorized body in the field of communication (further – authorized body) – the central executive body determined by the Government of the Republic of Kazakhstan, enabling the realization of state policy in the field of communication, the state control, coordination and regulation of activities of persons providing services in the field of communication or using them.
