About approval of Rules of use of communication networks using not geostationary satellites
According to the subitem 5) of Item 6 of article 23 of the Law of the Republic of Kazakhstan "About homeland security of the Republic of Kazakhstan" and subitem 111-3) of Item 15 of the Regulations on the Ministry of the digital development, innovations and the aerospace industry of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of July 12, 2019 No. 501, I ORDER:
1. Approve the enclosed Rules of use of communication networks using not geostationary satellites.
2. To provide to committee of telecommunications of the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan after its official publication;
3) within ten working days after state registration of this order its submission to Legal department of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.
3. This order becomes effective after ten calendar days after day of its first official publication and is effective till January 1, 2026.

1. These rules of use of communication networks using not geostationary satellites are developed according to subitem part four 5) of Item 6 of article 23 of the Law of the Republic of Kazakhstan "About homeland security of the Republic of Kazakhstan" (further - the Law "About homeland security of the Republic of Kazakhstan), and also subitem 111-3) of Item 15 of the Regulations on the Ministry of the digital development, innovations and the aerospace industry of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of July 12, 2019 No. 501, and determine procedure for use of communication networks using not geosynchronous companions within the pilot project operating till January 1, 2026 (further - pilot project).
2. The purposes of pilot project are:
1) experimental use of technology of not geosynchronous satellite communication systems;
2) determination of technical and legal barriers for functioning of not geosynchronous satellite communication systems during pilot project;
3) decision making about further possibility of use of not geosynchronous satellite communication systems in the territory of the Republic of Kazakhstan by results of pilot project.
At the same time participation in pilot project is performed only on voluntary basis.
3. In these rules the following basic concepts, reducings and abbreviations are used:
1) communication services - activities for acceptance, processing, storage, transfer, transportation, delivery of mail and special departures, postal money transfers or messages of telecommunications;
2) not geosynchronous satellite communication system (further - NGSSS) - the communication system functioning with use of grouping of the artificial Earth satellites located on not geostationary earth orbits;
3) the operator of not geosynchronous satellite communication system (further - the Operator NGSSS) - the telecom operator using grouping of the artificial Earth satellites located on not geostationary earth orbits;
4) network management system (further - SUS) - complex hardware-software and organizational technical means for communication network management;
5) administrator of the project - Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan;
6) service of Internet access - service in acceptance and data transmission with use of the Internet within pilot project;
7) the single gateway of Internet access (further - EShDI) - the hardware and software intended for protection of objects of informatization in case of Internet access and (or) to the communication networks having Internet connection;
8) system of centralized operation by networks of telecommunications of the Republic of Kazakhstan (further - TsUST) - the complex of organizational and technical actions for forming of managing parameters and to control of their execution including the hardware and software and communication links for centralized operation of telecommunications by networks;
9) the participant of pilot project - the legal entity receiving or rendering communication services by means of NGSSS within pilot project;
10) the National table (further - the Table) - the table of distribution of bands of frequencies between radio services of the Republic of Kazakhstan in the range of frequencies from 3 kHz to 400 GHz for radio-electronic means of all assignments approved by the order of the acting minister on investments and development of the Republic of Kazakhstan of January 20, 2015 No. 22 (it is registered in the Register of state registration of regulatory legal acts for No. 10375);
11) the International Telecommunication Union (further - MSE) - the international organization determining recommendations in the field of telecommunication and radio, and also regulating questions of the international use of radio frequencies (RF arrangement on assignments and over the countries).
Other concepts used within these rules are applied according to the Law of the Republic of Kazakhstan "About communication" (further - the Law) and other legal acts of the Republic of Kazakhstan, and also Radio regulations of the International Telecommunication Union.
