About subsidizing of legal entities in case of construction or acquisition of premises

For the purpose of enhancement of the state housing policies, creation of additional terms for growth in volumes of construction and acquisition of premises by the state organizations and economic societies (further - legal entities) for improvement of housing conditions of the workers:

1. Determine that:

1.1. legal entities are granted the right to subsidies for payment of part of interest for using the credits (further - subsidies) for the subsequent provision of the premises built or acquired with use of subsidies, to the workers;

1.2. subsidies are provided to legal entities:

performing construction of premises in apartment houses:

by which they are determined by builders (customers);

based on the agreements of creation of objects of shared-equity construction signed with builders (customers);

acquiring premises:

construction which reconstruction were performed according to the state order according to the Presidential decree of the Republic of Belarus of May 8, 2013 No. 215 "About some measures for enhancement of construction (construction, reconstruction) premises";

the built by municipal unitary enterprises on capital construction, their affiliated unitary enterprises, the organizations of large-panel housing construction, national associations which part the organizations of large-panel housing construction are, other state organizations or economic societies, more than 50 percent of shares (share in authorized funds) of which belongs to the Republic of Belarus and (or) its administrative and territorial unit, at the expense of own means, the credits and the constructions which are not realized by them before completion, except for the premises which are in municipal property of Minsk;

1.3. subsidies are provided in the amount of 50 percent of the refunding rate of National Bank operating (taking into account its change) in the corresponding period of charge of percent.

Subsidies:

are provided based on the decisions made according to subitem 1.4 of this Item since next month after provision of the credit by bank (its part) monthly during the whole loan repayment period established by the credit agreement;

are not provided for interest payment, added on the amount of the overdue and (or) deferred (spread) debt on principal debt on the credits.

The procedure for provision of subsidies is determined by Council of Ministers of the Republic of Belarus;

1.4. decisions on provision to legal entities of subsidies are made district, city (the cities of regional and district subordination) by executive committees, local administrations of areas in the cities in the location of the corresponding legal entities within amounts of construction and acquisition of premises with use of the subsidies which are annually determined by Council of Ministers of the Republic of Belarus. Within seven working days from the date of adoption of these solutions of their copy (the statement from decisions) go to the territorial organizations for state registration of real estate, the rights to it and transactions with it for the location of the built, acquired premises;

1.5. the state organizations performing construction or acquisition of premises at the expense of own means and (or) with attraction of the credits, including with use of subsidies and also the economic societies performing construction or acquisition of premises with use of subsidies:

independently determine procedure and conditions of provision of such premises, and also categories of citizens from number of persons employed of these legal entities having the first-priority right to provision of the premises built or acquired with use of subsidies according to local legal acts (including collective agreements). At the same time at least 20 percent from total quantity of the premises (every first of five premises) built or acquired with use of subsidies are subject to provision in first-priority procedure to young specialists and citizens aged till 31 year (in case of their availability) on condition of absence at them, and also at members of their families to whom together with the called citizens housing, other premises in property (share in the right of common property to premises) and (or) in ownership and use (except for the premises occupied by citizens according to the employment contract of premises in the hostel, to the employment contract of premises of private housing stock) in the settlement on place of employment (service) is provided;

provide to the workers these premises relating:

to the state housing stock, - on terms of the contract of hiring of rent housing;

to private housing stock, - on terms of the contract of hiring of premises of private housing stock;

establish for the workers the amount of payment for use of such premises provided on the terms of agreements, the specified in paragraphs four and the fifth to this part for their employment relationships, at least the size of payment for use of rent housing determined according to parts third or heel of Item 2 of article 31 of the Housing code of the Republic of Belarus.

In the absence of the statements of employees of the state organization for provision of the premises built or acquired at the expense of own means and (or) with attraction of the credits, including with use of subsidies (the statements of employees of economic society for provision of the premises built or acquired with use of subsidies) on the terms of agreements, the specified in paragraphs four and the fifth part one of this subitem, such premises are provided to workers of other legal entities who are logging in (structure, structure) or subordinated to this state organization, economic society or logging in (structure, structure) or subordinated to state body, the state organization, economic society, the system (structure, structure) of which also includes (under which supervision also is) this state organization, economic society, based on individual petitions of legal entities;

1.6. the premises built or acquired by the state organizations at the expense of own means and (or) with attraction of the credits, including with use of subsidies are assigned to these organizations on the right of economic maintaining or operational management and are not subject to transfer without their consent to economic maintaining, operational management or free use of other legal entities if other is not determined by the President of the Republic of Belarus;

1.7. the money received from provision of the premises built or acquired by the state organizations at the expense of own means and (or) with attraction of the credits, including with use of subsidies and also from provision of the premises built or acquired by economic societies with use of subsidies in the amount of payment for use by them of penalty fee for untimely and (or) incomplete introduction of such payment remains at the disposal of these state organizations, economic societies and is used on:

return (repayment) of the credits for construction or acquisition of premises, interest payment for use of these credits;
