The state committees on special mechanical engineering and conversion of the Azerbaijan Republic and Industry ministry, science and technologies of the Russian Federation which are hereinafter referred to as with the Parties

based on provisions of the Agreement on creation of Economic union of September 24, 1993 and the Agreement between the Government of the Azerbaijan Republic and the Government of the Russian Federation on production and scientific and technical cooperation of the companies of defense industries of December 25, 1993,

considering the developed production and technological bonds between the companies and the organizations of the Azerbaijan Republic of the industry and the companies and the organizations of the Russian Federation,

recognizing crucial role of economic cooperation between the Azerbaijani and Russian business entities in the conditions of the market relations,

aiming to provide favorable conditions for maintenance and mutually beneficial development of production cooperation and direct connections between the companies and the organizations of the industry of the Azerbaijan Republic and the companies and the organizations of the Russian Federation,

agreed as follows:

Article 1

The parties promote adjustment and development of bonds between business entities of the Azerbaijan Republic and the Russian Federation on the basis of mutual advantage and non-admission of the actions causing economic damage to any of the states of the Parties.

Article 2

The parties assist implementation of research and development works on the basis of joint target programs of development and production of industrial output (further products) on the terms of the signed intergovernmental agreements and with preserving the operating economic bonds, the existing procedure for development, statement on production, delivery and testing of products at the companies and in the organizations of the Azerbaijan Republic and the Russian Federation

Article 3

The parties promote mutual contractual (contractual) deliveries between the companies and the organizations of the Azerbaijan Republic and the Russian Federation of the materials, components and other material resources necessary for production according to the Agreement between the Government of the Azerbaijan Republic and the Government of the Russian Federation on production and scientific and technical cooperation of the companies of defense industries of December 25, 1993 according to annually approved lists containing supplier lists and consumers, the nomenclature and amounts of mutually delivered goods.

The parties promote preserving the developed production and scientific and technical specialization of the companies and organizations participating in development, production and testing of products.

Article 4

The parties cooperate in area of investing activities and pricing, including in questions of pricing on products of enterprise monopolists of machine-building complex.

Article 5

The parties take measures for non-admission of presentation by suppliers unilaterally, in case of the conclusion and execution of contracts (contracts) for delivery of products, additional requirements about counter delivery of goods, rendering the services which are not connected with its production and payment of products in freely convertible currency, except for deliveries of products to export to the third countries.

Article 6

The parties promote exchange of scientific and technical information, reference and other technical documentation on the made products according to the legislation of the Azerbaijan Republic and the legislation of the Russian Federation.

Article 7

The parties not transfer the received products, documentation and information to the third party, including foreign physical persons and legal entities without prior written consent of the transferring Party.

The parties undertake obligations on information security of the closed nature within the legislation of the Azerbaijan Republic and the Russian Federation.

Article 8

The parties cooperate in carrying out coordinated policy in the field of standardization, metrology and certification, keep the developed procedure for providing the companies with the specifications and technical documentation.

By coproduction of components to products of the company, being under authority of the Parties, acceptance and to conducting damage work which is intended for production of specific products are guided by that specifications and technical documentation on standardization, unification and rules of testing.

Article 9

Removal from production of the components, materials and raw materials going for production, repair and maintenance of products is carried out by mutual consent of the Parties.

Article 10

The parties shall render every possible assistance to the companies in their export policy on the basis of preserving and further development of sci-tech cooperation, interstate cooperation and mutually advantageous settlement system for products sold to the third countries within the existing Azerbaijani and Russian legislation.

Article 11

The parties promote education of interstate financial and industrial groups, production associations, associations and joint-stock companies of different patterns of ownership which activities will be directed to stabilization and development of production.

Article 12

As agreed by the parties changes and additions which are drawn up by the separate protocols which are becoming effective according to the procedure stipulated in Article the 14th this agreement can be made to this agreement and are integral parts of this agreement.

Article 13

All disputes which arose between the Parties on interpretation and application of provisions of this agreement are solved by carrying out consultations and negotiations between the Parties.
