About authorization of conformity assessment bodies and introduction of amendments to some resolutions of the Cabinet of Ministers of the Kyrgyz Republic in the sphere of assessment of conformity

For the purpose of implementation of the Agreement on procedure and conditions of the elimination of technical barriers in mutual trade with the third countries signed on November 22, 2021 in the city of Moscow according to article 27 of the Law of the Kyrgyz Republic "About technical regulation in the Kyrgyz Republic", articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve Regulations on authorization of conformity assessment bodies on work to requirements of technical regulations and/or mutual recognition of results of assessment of conformity of objects of technical regulation to mandatory requirements according to appendix.

2. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About some questions in the sphere of assessment of conformity" of May 20, 2022 No. 267 the following change:

- in item 4 of the word "before decision making by national authority on accreditation" shall be replaced with words "according to the appeal of national authority on accreditation and before adoption of the decision by it".

3. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of Requirements to experts in certification (experts-auditors), the body which is carrying out confirmation of competence of experts on certifications (experts-auditors), procedure for confirmation of their competence, forming and maintaining the unified register of experts on certifications (experts-auditors)" of February 28, 2023 No. 107 the following changes:

To exclude 1) in Item 2 of the word "or accredited body on certification of personnel according to area of accreditation";

To exclude 2) in Item 7 of the word "and to accredited body on certification of personnel";

3) in Requirements to experts in certification (experts-auditors), the body which is carrying out confirmation of competence of experts on certifications (experts-auditors), procedure for confirmation of their competence, forming and maintaining the unified register of experts on certifications (experts-auditors) approved by the above-stated resolution:

- to state the subitem 1 of Item 2 in the following edition:

"1) body - the Center for standardization and metrology under the Ministry of Economy and Trade of the Kyrgyz Republic which is carrying out confirmation of competence of the expert in certification;";

- in Item 3:

state subitem 1 in the following edition:

"1) to have higher education in the corresponding field of activity and/or technical education on the declared field of certification or additional professional education in the specialty and/or to the direction of preparation or academic degree on scientific specialty, the respective area of certification of the expert in certification, in case of work on confirmation of conformity;";

in subitem 2 of the word "more than one year" shall be replaced with words "at least two years - the specialist in certification in the declared field of certification";

- add Item 5 with the paragraph of the following content:

"-requirements to processes and to production organization of products; types of testing of products; methods (techniques) of testing and measurements; the organizations of incoming inspection of raw materials, materials, components, control of products in production process and finished goods; bases of metrological support of production; statistical techniques of quality evaluation and reliability of products; requirements to marking of products.";

- add Item 6 with paragraphs of the following content:

"-the accomplishment of the procedure of confirmation of conformity and methods of estimates (audit) established by Procedure for confirmation of conformity of the Kyrgyz Republic;

- productive planning and organization of work;

- evaluating (audit) during the established time and within the approved plan of assessment (audit), respecting time rules depending on activity;

- confirmation of sufficiency and the acceptability of evaluation criteria (audit) for reasons for observations and the conclusions of assessment (audit);

If education of the applicant does not correspond to the declared field of certification, availability of additional higher education (offline) in the specialty is necessary and/or for the corresponding direction and length of service at least three years by the specialist in certification on the declared field of certification.";
