About introduction of amendments to some acts of the Government of the Russian Federation

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation.

2. Determine that the changes approved by this resolution are considered in case of price fixation (rates) for services in transfer of electrical energy for 2025, and also subsequent periods of regulation also are applied since January 1, 2025 to the relations arising on the basis:

electrical power transmission agreements;

the non-paid agreements determining the mutual rights and obligations in case of interaction of the network organizations which objects of electric grid economy are technologically attached to each other.

3. Determine that for the purpose of transition to legal regulation of the relations arising based on electrical power transmission agreements using the changes approved by this resolution:

a) the guaranteeing suppliers power supplying the organizations, the power sales organizations and the territorial network organizations (except for those which correspond to the criteria of reference of the territorial network organizations established by the Government of the Russian Federation to the network organizations servicing mainly one consumer) till October 1, 2024 send to the systemically important territorial network organizations performing activities in appropriate subject of the Russian Federation, up-to-date information about consumers of electrical energy who (for the benefit of which) sign agreements of power supply or purchase and sale of electrical energy with the guaranteeing suppliers power supplying with the organizations, the power sales organizations and electrical power transmission agreements with the territorial network organizations (information goes in forms, the provided appendix No. 2 to the Basic provisions of functioning of the retail markets of electrical energy approved by the order of the Government of the Russian Federation of May 4, 2012 No. 442 "About functioning of the retail markets of electrical energy, complete and (or) partial restriction of the mode of consumption of electrical energy");

b) the systemically important territorial network organizations in case of absence at them current agreements of rendering the services in transfer of electrical energy concluded no later than September 1, 2024 till October 14, 2024 send to the guaranteeing suppliers and the territorial network organizations which are performing activities in the same subject of the Russian Federation, as the systemically important territorial network organization, to the power supplying organizations and the power sales organizations with which agreements of power supply are signed and information on which was obtained according to the subitem "an" of this Item, to consumers of electrical energy, information on whom was obtained according to the subitem "an" of this Item, offers - offers on the conclusion with them no later than February 28, 2025 (no later than October 30, 2024 - for the territorial network organizations) electrical power transmission agreements taking into account changes, the obligations approved by this resolution, providing origin since January 1, 2025;

the systemically important territorial network organizations in case of availability at them current agreements of rendering the services in transfer of electrical energy concluded no later than September 1, 2024 with persons specified in paragraph one of this subitem till October 14, 2024 send to such persons of the offer on the conclusion no later than February 28, 2025 (no later than October 30, 2024 - for the territorial network organizations) supplementary agreements to current agreements of rendering services in transfer of electrical energy taking into account the changes approved by this resolution, providing emergence of obligations since January 1, 2025;

c) the executive body of the subject of the Russian Federation authorized in the field of state regulation of the prices (rates) within 5 working days from the date of acceptance in accordance with the established procedure publishes decisions on determination of the systemically important territorial network organization in the official printing publication in which legal acts of public authorities of appropriate subject of the Russian Federation are published, and places in electronic means of distribution of information (including with use of the Internet) data:

about the systemically important territorial network organization determined in appropriate subject of the Russian Federation;

about categories of persons belonging since January 1, 2025 to consumers of services in transfer of electrical energy which shall be such organization;

about effects of use of the specified services without agreement after January 1, 2025;

d) persons relating to consumers of services in transfer of electrical energy which shall be the systemically important territorial network organization its offers which notified such organization on acceptance to sign the electrical power transmission agreement (the consumers of electrical energy who accepted the specified offer including by payment completely of services for the first settlement period in accordance with the terms of such agreement regardless of the fact of its signing) shall pay the services which are actually rendered to them since January 1, 2025;

e) use after February 28, 2025 of the faces relating to consumers of services in transfer of electrical energy which shall be the systemically important territorial network organization services in transfer of electrical energy without contract with the systemically important territorial network organization (including if the agreement is not signed by means of the acceptance in payment type completely of services for the first settlement period) is the basis for introduction at the initiative of the systemically important territorial network organization of restriction of the mode of consumption of electrical energy according to the procedure, similar established for the cases specified in the subitem "v" of Item 2 of the Rules of complete and (or) partial restriction of the mode of consumption of electrical energy approved by the order of the Government of the Russian Federation of May 4, 2012 No. 442 "About functioning of the retail markets of electrical energy complete and (or) partial restriction of the mode of consumption of electrical energy" (at the same time observance of requirements of the paragraph of the fourth Item 23 of the specified Rules is not required). The effects provided by this subitem are applied to persons specified in the subitem "b" of this Item provided that with observance of requirements of this subitem the offer of the systemically important territorial network organization on the conclusion of the electrical power transmission agreement was sent them;

e) the services in transfer of electrical energy which are actually rendered since January 1, 2025 by the systemically important territorial network organization without the conclusion of the contract with it are subject to payment after February 28, 2025:

by single (boiler) tariffs for services in transfer of electrical energy;

in the amount corresponding to amount of consumption of electrical energy since January 1, 2025 which is determined according to the procedure, established by the Rules of non-discriminatory access to services in transfer of electrical energy and rendering these services approved by the order of the Government of the Russian Federation of December 27, 2004 No. 861 "About approval of Rules of non-discriminatory access to services in transfer of electrical energy and rendering these services, Rules of non-discriminatory access to services in supervisory control in power industry and rendering these services, Rules of non-discriminatory access to services of the commercial operator of the wholesale market and rendering these services and Rules of technological connection of power receiving devices of consumers of electrical energy, facilities for production of electrical energy, and also the objects of electric grid economy belonging to the network organizations and other persons to power networks" and the order of the Government of the Russian Federation of May 4, 2012 No. 442 "About functioning of the retail markets of electrical energy, complete and (or) partial restriction of the mode of consumption of electrical energy", for determination of agreement obligations with the systemically important territorial network organization;

g) in case of price fixation (rates) for services in transfer of electrical energy for 2025 from the systemically important territorial network organization observance of provisions of the subitem 13 of Item 17 of Rules of state regulation (review, application) the prices (rates) in power industry approved by the order of the Government of the Russian Federation of the December 29, 2011 No. 1178 "About pricing in the field of regulated prices (rates) in power industry", about confirmation planned in the specified year of implementation of regulated activities by the signed electrical power transmission agreements is not required;

h) the systemically important territorial network organization which received from the territorial network organizations performing activities in the same subject of the Russian Federation as the systemically important territorial network organization including which have no adjacent points of accession to objects of electric grid economy of the systemically important territorial network organization, the notification on adoption of its offer to sign the electrical power transmission agreement shall sign with each specified territorial network organization the electrical power transmission agreement no later than the term specified in the subitem "b" of Item 3 of this resolution and pay the services which are actually rendered by them since January 1, 2025 for the established rates for settlings with the territorial network organization.

4. In the territory of the subject of the Russian Federation - the federal city of Moscow according to the Federal Law "About Power Industry" taking into account the features established by the Law of the Russian Federation "About the status of the capital of the Russian Federation" provisions of subitems "an" and "b" of Item 3 of this resolution are applied taking into account borders of the zones of activities established for each of 2 systemically important territorial network organizations by the solution of the management official of the subject of the Russian Federation - the federal city of Moscow. In addition to the data specified in the subitem "v" of Item 3 of this resolution also data on borders of zones of activities of each of the systemically important territorial network organizations are published and placed.

5. To the Ministry of Energy of the Russian Federation within 6 months from the date of entry into force of this resolution to bring into accord with the changes approved by this resolution, the single quality standards of servicing by the network organizations of consumers of services of the network organizations.
