1. Approve Regulations on implementation of the procedure of prior reasonable consent concerning separate dangerous chemicals and pesticides in foreign trade activity it (is applied).
2. No. 877 "About cooperation with the international organizations and interstate educations" to add Item 7 of the Section "Ministry of Health" of appendix 1 to the resolution of Council of Ministers of the Republic of Belarus of November 21, 2017 with subitem 7.4 of the following content:
"7.4. The Rotterdam convention on the procedure of prior reasonable consent concerning separate dangerous chemicals and pesticides in international trade.".
3. To the Ministry of Health together with the interested republican state bodies to take measures for implementation of this resolution.
4. This resolution becomes effective after its official publication.

1. This Provision determines procedure of the procedure of the prior reasonable consent concerning separate dangerous chemicals and pesticides (further – prior reasonable consent) provided by the Rotterdam convention on the procedure of prior reasonable consent concerning separate dangerous chemicals and pesticides in the international trade accepted in Rotterdam on September 10, 1998 (further – the Rotterdam convention), and notifications on export of chemicals and pesticides in foreign trade activity (further – the notification on export).
The Ministry of Health (further – the appointed national authority) is actionee of obligations assumed by the Republic of Belarus under the Rotterdam convention.
2. For the purposes of this provision terms and their determinations in the values determined in article 2 of the Rotterdam convention are used.
3. The procedure of prior reasonable consent is performed according to provisions of articles 10 and 11 of the Rotterdam convention concerning separate dangerous chemicals and pesticides according to appendix 1.
4. For the purposes of implementation of the procedure of prior reasonable consent by the appointed national authority are considered provided by exporters and (or) importers according to the Rotterdam convention:
information on chemicals and pesticides (further, unless otherwise specified, – chemical), their dangerous properties, category and (or) subcategory of use, about use restriction type if they fall under restriction;
the information containing on the marking of chemical applied on packaging or the marking label, including including dates of production and expiry date of chemical;
the material safety data sheet of chemical products of the established form.
Information and material safety data sheet of chemical products specified in part one of this Item are accepted by the appointed national authority in official languages of the state which is the party of the Rotterdam convention (further – the Party), and in one of state languages of the Republic of Belarus.
5. At the request of the appointed national authority each importer of chemicals provides information and the material safety data sheet of chemical products specified in part one of item 4 of the this provision, including information on quantity imported to the Republic of Belarus of chemical and (or) the mix containing chemical in concentration of more 0,1 of percent (further – mix).
6. By provision by the exporter and (or) importer according to part one of item 4 and Item 5 of this provision of information not in full and failure to provide the material safety data sheet of chemical products the appointed national authority requests missing information and the material safety data sheet of chemical products.
7. The exporter intending to export for the first time to the Party from the Republic of Belarus chemical and (or) mix sends to the appointed national authority information:
about intention to export chemical;
about chemical and mix in volume of the data provided in the notification on export in form according to appendix 2.
8. The appointed national authority in case of the direction to the Parties of notifications on export:
registers each notification on export;
checks compliance of information provided by the exporter, to amount of the data provided in the notification on export;
sends the notification on export to the appointed national authority of the importing Party no later than 30 calendar days from registration date of the notification on export;
takes the measures necessary for receipt of the corresponding answer from the appointed national authority of the importing Party;
directs the notification on export repeatedly in case of non receipt from the appointed national authority of the importing Party of confirmation about receipt of the notification on export within 30 calendar days from the date of its direction;
addresses for consultations to the Secretariat of the Rotterdam convention in case of non receipt from the importing Party of the answer within 60 calendar days after the direction of notifications on export.
The appointed national authority after consultations with the Secretariat of the Rotterdam convention on each case makes the decision on possibility of implementation of export of chemical if its use is not forbidden or it does not fall under strict restriction in the importing Party, in case of observance of the following conditions:
chemical is registered and (or) it is authorized in the importing Party;
chemical was used in the territory of the importing Party and (or) imported to it.
9. The exporter which continues to export to the Party from the Republic of Belarus chemical sends to the appointed national authority annually:
not later than 45 calendar days before date of export – information on implementation of the first export of chemical next calendar year;
